Heartless. An elderly person charged for making some random comments. The cruelty of treating a senior citizen like this is barbaric. His physical state obviously reveals what he went through.

The way the Supreme Court has deployed the proportionality test in the SIR judgment could become a textbook example of abusive judicial review to teach in classrooms. Staggering dishonesty in equating demonetisation with SIR and insisting on deference. The demonetisation judgment itself was problematic. But the SIR judgment is quite something.

I did not to go to the Supreme Court today to hear its order in the SIR case. As a litigant in this case, and as someone who was given the honour of addressing the court, I should have been hopeful, anxious, or at least curious. I was not. The case was decided long ago. We were only waiting for the transcript and its fine print. The course of this case was settled in August last year. Having heard arguments against SIR for three days, the court moved away from examining the constitutionality of SIR and effectively converted itself into a Consumer Forum, focused on grievance redressal and arbitration, rather than constitutional principles. The case was effectively decided when the apex court allowed the ECI to rush through the Bihar elections without first deciding the matter, and without requiring the ECI to rectify even the most glaring defects in post-SIR rolls. There was little left of this case once the ECI proceeded with the second and then the third phase of SIR, while the Hon’ble Court leisurely heard arguments about its constitutionality. SIR had become a fait accompli. Any remaining doubt disappeared when the Hon’ble judges observed in open court that no one would be allowed to obstruct SIR. The final nail in the coffin of this petition was hammered during the hearing of another petition before the same Bench, when an Hon’ble judge remarked that millions denied their right to vote need not fret, since they could vote in the next election. At that moment, the court abdicated its constitutional responsibility. Shorn of legalese, the simple truth is that the highest court of a constitutional democracy has already authorised the disenfranchisement of millions of citizens — at least 59 million so far, could go up eventually to 100 million. It was inconceivable that the court would now declare SIR unconstitutional and annul all post-SIR elections. The lawyers were waiting for the the exact legal reasoning deployed to arrive at a conclusion that was already known. Such legal gymnastics did not interest me. Some friends were looking for some crumbs in the hope that the court might at least wish to save face, if not save the voters. Eventually that too did not happen. Polite noises apart, the Court has handed over a carteblac to the ECI to do what it pleases with the voters list. ADR vs Union of India (2026) is to our times what ADM Jabalpur vs Shivkant Shukla (1976) was to the previous assault on our democracy. We must hope that the SIR judgment does not mark the crumbling of the last constitutional wall, as ADM Jabalpur once did. We must believe that one day this constitutional abdication by the guardian of the Constitution will be recognised for what it was. And reversed. Jai Hind!

உறைந்த சாதியமும் அதை உருக விடாத சுப. வீரபாண்டியன்களும்: பேராசிரியர் சுப.வீரபாண்டியன் அவர்கள் கருஞ்சட்டைத் தமிழர் இணைய இதழில் இன்று எழுதியுள்ள குறும் கட்டுரையில், த.வெ.க பட்டியலின சட்டமன்ற உறுப்பினர்களுக்கு வழங்கியிருக்கும் பிரதிநித்துவத்தை பாஜக வழங்கியிருக்கும் பிரதிநித்துவத்தோடு ஒப்பிட்டு பேசுகிறார். “இவற்றை நாமும் பாராட்டுகிறோம்” என்று ஒரு வரியில் குறிப்பிட்டுவிட்டு, அந்த மாற்றத்தை முழுமையாக ஏற்றுக்கொள்ள முடியாத ஆதங்கமும் அதில் வெளிப்படுகிறது. நீதிக்கட்சி காலத்திலிருந்தே, வெள்ளாளர் மற்றும் இடைநிலைச் சாதிகளிடம் குவிந்து கிடக்கும் அதிகாரத்திற்கு எதிராக நாம் தொடர்ந்து கேள்வி எழுப்பி வருகிறோம். அதன் நீட்சியாகத்தான் திமுகவையும் விமர்சிக்கிறோம். திமுக என்பது ஒரு தேர்தல் அரசியல் அதிகாரம். நம் விமர்சனத்தை அவர்கள் வெளிப்படையாக ஏற்றுக்கொள்ளாதது போல தோன்றினாலும், அந்த விமர்சனங்கள் அவர்களது அரசியலில் தாக்கம் ஏற்படுத்தாமல் போவதில்லை. குறிப்பாக இந்தத் தேர்தலில் நிகழ்ந்துள்ள மாற்றங்கள், பழைய திமுக அரசியலுக்கு ஒரு முக்கியமான படிப்பினையாக அமைந்துள்ளன. பழைய குறுநில மன்னர் அரசியலைத் தாண்டி, பிரதிநித்துவ அரசியலை மேலும் விரிவுபடுத்த வேண்டிய கட்டாயம் திமுகவிற்கு உருவாகியுள்ளது. ஆனால், தமிழ்நாட்டின் OBC அரசியலை சமூகநீதி அரசியலாக முன்வைத்து வந்த பல முற்போக்கு வட்டாரங்கள், அந்த அரசியலின் எல்லைகளை மறுபரிசீலனை செய்யத் தயாராக இருப்பதாக தெரியவில்லை. அதனால் தான் தற்போதைய த.வெ.க பிரதிநித்துவத்தை கூட, நேரடியாக எதிர்கொள்ளாமல் பாஜக அரசியலோடு ஒப்பிட்டு பேச வேண்டிய நிலை உருவாகிறது. சுப.வீரபாண்டியன் அவர்களிடம் சில கேள்விகள்: பிரபஞ்ச அளவில் ஒப்பிட்டுப் பார்த்தாலும், “எங்கள் சமூகநீதியே சிறந்த சமூகநீதி” என்று நம்பும் திமுக, ஏன் இதுவரை இப்படியான பிரதிநித்துவத்தை சாத்தியப்படுத்தவில்லை? தேசிய காங்கிரஸ் கட்சி, அகில இந்திய தலைவராக ஒரு தலித்தை தேர்வு செய்து அவருக்கு உரிய அதிகாரத்தையும் வழங்கியிருக்கிறது. ஆனால், திராவிட இயக்க அரசியலில் தலித்துகள் தலைமை நிலைக்கு வருவது ஏன் இன்னமும் சாத்தியப்படவேயில்லை? தேசிய காங்கிரஸ் தன் குடும்பத்திற்கு வெளியிலிருந்து பல பிரதமர்களை உருவாக்கியிருக்கிறது. ஆனால் அண்ணா மறைவுக்குப் பிறகு கலைஞர் குடும்பத்திற்கு வந்த அதிகாரம், ஏன் அங்கேயே தேக்கம் கண்டிருக்கிறது? அண்டை மாநிலமான ஆந்திராவில் ஜெகன் மோகன் ரெட்டி ஆட்சியில், பட்டியலின மற்றும் பழங்குடியின பெண்கள் உட்பட ஐந்து துணை முதல்வர்கள் நியமிக்கப்பட்டனர். ஆனால் திமுகவில் ஸ்டாலின், உதயநிதி ஸ்டாலின் மட்டுமே துணை முதல்வராக முடிகிறது. இது எந்த வகையான ஜனநாயக மாதிரி? கருணாநிதி மாவட்ட அளவில் தலித்துகளுக்கு துணைப் பொதுச்செயலாளர் பதவியை வழங்கும் திருத்தத்தை கொண்டு வந்தார். ஆனால் அந்த அமைப்பிலிருந்து, துரைமுருகன், பொன்முடி, MRK பன்னீர்செல்வம், ஐ. பெரியசாமி, எ.வ.வேலு, கே. என்.நேரு, ஆவுடையப்பன், கீதா ஜீவன், தங்கம் தென்னரசு, கதிர் ஆனந்த், கௌதம சிகாமணி, த.மோ அன்பரசன், பெரியகருப்பன் , RD சேகர், சேகர் பாபு போன்ற மாநிலம் முழுக்க அறியப்பட்ட ஆளுமைகள் உருவானது போல, எத்தனை ஆளுமைமிக்க வட்டார தலித் தலைவர்கள் உருவாகியிருக்கிறார்கள்? தமிழ்நாட்டின் மக்கள் தொகையில் குறிப்பிடத்தக்க பங்காக இருக்கும் பட்டியலின மக்களிலிருந்து, 72 மாவட்ட செயலாளர்களில் பத்து பேரைக் கூட திமுக தொடர்ந்து உருவாக்க முடியவில்லையென்றால், இந்தக் கட்சியின் சமூகநீதி அரசியல் யாருக்காக செயல்படுகிறது என்ற கேள்வி இயல்பாகவே எழுகிறது. இது போன்ற ஏராளமான கேள்விகளை வரலாற்றின் பல பக்கங்களில் இருந்து முன்வைக்க முடியும். அவற்றை ஆரோக்கியமான விமர்சனமாக எடுத்துக்கொண்டு, ஆதிக்கச் சாதிகளிடம் குவிந்து கிடக்கும் அதிகாரத்தை உடைத்து, புதிய மாற்றங்களை நோக்கி நகர வேண்டிய தேவை இருக்கிறது. பாஜகவை ஒரு துருப்புச் சீட்டாக பயன்படுத்தி எல்லா விமர்சனங்களையும் திசைதிருப்பும் அரசியல் நீண்ட காலம் நீடிக்காது. நேர்மையான விமர்சனங்களையும், புதிய தலைமுறையின் பிரதிநித்துவக் கோரிக்கைகளையும் எதிர்கொள்ள வேண்டிய காலம் இது. முன்முடிவுகளற்ற ஒரு புதிய பிரதிநித்துவ அரசியல் உருவாகத் தொடங்கியுள்ளது. அதுவும் இத்தனை ஆண்டுகளாக முன்வைக்கப்பட்ட விமர்சனங்களின் விளைவே. அந்த மாற்றங்களை வளர்த்தெடுக்க வேண்டும். முற்போக்கு அரசியலுக்குள்ளேயே உறைந்து கிடக்கும் சாதி மனநிலைகளை, புதிய தலைமுறை உருவாக்கும் மாற்றங்கள் கேள்விக்குள்ளாக்கத் தொடங்கியிருக்கின்றன. பாரதிய ஜனதா என்கிற ஒரு வார்த்தையை நீக்கி விட்டால், உங்கள் கட்டுரை ஆதிக்கச் சாதியின் குமுறல் மட்டுமே, அதன் பொருட்டே இந்த ஒப்பீடு உங்களுக்கு தோன்றுகிறது என்பதை லட்சக்கணக்கான தலித் இளைஞர்கள் அறிவர். அவர்களது நம்பிக்கையை பெற முன்முடிவுகளற்று பேசும் நேர்மையை பெறுங்கள்.

I have no problem in accepting your main argument that BJP is winning elections while losing the economy. On the economic substance, you are largely right. Given your support for Modi and team, this article will draw much attention. However... You set up a four-agent framework and then promptly walk away from it. The fourth agent, the puppeteer, gets introduced and quickly abandoned. We were waiting, Surjit. Because that is precisely where the real story lives. BJP's ability to win elections while presiding over economic underperformance rests on three things you barely touch: mainstream media now largely singing from the same hymn sheet; serious questions about electoral processes; weaponizing of public institutions against the opposition, and a financial resource asymmetry that can only be overcome in exceptional circumstances. These four reinforce each other in ways that make economic accountability impossible. And then the Gandhi family dig. Really? Congress's chalenges are a far more complex story. Some of the problems are internal, but many have to do with the institutional, media and financial asymmetries you gloss over. Blaming the Gandhis lets BJP off the hook for engineering a structurally uneven playing field. And, might I add, it is the Gandhis who give fearless voice to the frustration felt by so many in India about the issues that you feel have made India a member of the Fragile 2.

Congrats to @RameshOffcl on becoming the HR&CE Minister. He takes over at a crucial time when the HR&CE Act itself is under legal pressure in the Supreme Court. I hope this is given the seriousness it deserves. #TVKVijay‌ @CMOTamilnadu

On the whole, India's energy shock is drawing far lesser reporting than demonetisation or GST. The little reportage we have is scattered and episodic, not systematic or sustained. After 12 years of spoon-feeding and coercion from the NDA, newsrooms have forgotten how to report.
