It is theft of service because the “free breakfast” is contingent upon being a hotel guest and the service was in reference to the personnel manning the buffet. I know this one because I watched this happen to someone in San Diego. She got caught when she couldn’t produce a key or room number when the staff asked her for it. They told her that she could pay $40 for the meal, as visitor, or they would contact the police about theft of service. They ended up calling the police, making her pay for the meal or she would have had charges filed, and the hotel trespassed her.

If 1 person does it every day for a year, that is $1095/year. That seemingly small hit to the profit margin every day could mean the difference between being able to give your existing employees a $0.50/hour raise, or hiring another employee. Think about if 10 people did it, or more.
