@DA_JHB has received whistle blower info that allegedly @DadaMorero is plotting to distabilise the City, allegedly fabricating charges against CM, GCFO and other Senior officials for listing risks to the @CityofJoburgZA in the Adjustment budget report. Allegedly this will include a smear campaign against Cllrs & senior officials like CM & other's @MYANC seems desperate to loot the City’s resources to fund its 2026 Local Government election campaign & including the so called "shutdown Joburg" campaign to stop service delivery . I got a notification this morning from our lawyer friends that I do not know. It read, "FINAL DEMAND: MR LB MAHLANGU, despite previous notifications, your SABC TV Lic acc 479****471 for R*** remains unpaid. Failure to pay within 48hrs will result in further penalties. Pay now: payat.io/qr/***** VVM 0877401212:" Very spicy and confrontational. I think they were trying to scare me to submission, but it had the opposite effect. It made me curious and I started going down the rabbit hole, researching the origin of the TV license. I had written before about the introduction of TVs in 1976, but I had never delved deeper into the TV license fee. South Africa’s TV licence system was designed in a different era, when owning a television almost automatically meant consuming public broadcast content. To be precise, this was in 1976 when televisions were introduced. Under the Constitution of our beloved republic, laws must be rational, non-arbitrary and serve a legitimate public purpose. Now let’s apply this scrutiny to TV licences quickly. Well, from examination, they do pass the first hurdle because they are not classified as a tax, but rather as a regulatory fee tied to public broadcasting. What this essentially means from a legal point of view is that the licence exists to fund the South African Broadcasting Corporation (SABC), support local content, public-interest news and broadcasting in all of our eleven (11) official languages. Courts have historically accepted that owning regulated property (such as a TV, vehicle or firearm) can carry legal obligations. The problem, it seems, is not the goal of the TV licence. Public broadcasting is a legitimate constitutional objective. The problem is the mechanism, insofar as it relates to funding. The difference between 1976 (when TVs first came) and today is that we use TVs for streaming, gaming and presentations. But it would be disingenuous to limit it to just those things. There are still millions of South Africans who sconsume SABC content but it doesn’t change the fact that public broadcasting today is platform-agnostic. Apart from SABC, we watch Moja Love, Mzansi Magic and eTV. I haven't even mentioned all the other channels that you'd get on a DStv package. This might seem like a small detail but upon introspection, you'll realize that it weakens the rational connection between owning a television and funding public broadcasting. By its nature, constitutionalism is such that when a law no longer achieves its purpose effectively, it becomes vulnerable to being declared irrational or arbitrary. But I hate to break it to you, TV licences are not going away anytime soon. If challenged, a court is unlikely to abolish the TV licence outright. Instead, it would probably rule that the objective remains valid, but the funding model is outdated (rightly so) and must be revised by Parliament. South African courts typically favour legislative correction over demolition. TV licences survive not because they make economic sense, but because the law has not yet caught up with technological reality, which is the SABC no longer enjoys the monopoly on broadcasting. They remain constitutional but are living on borrowed time. The real question is no longer whether the TV licence is constitutional, but how long parliament can avoid replacing a broken model without triggering constitutional intervention. And I will pay my lawyer friends as soon as I find the willpower to do so. For now, I don't care😅

The rating agencies want Cyril Ramaphosa as president The IMF want Cyril Ramaphosa as president. The European Union wants Ramaphosa as president. The DA.PA andIFP want Ramaphosa as The President. The MKP openly say we are hungry and need to remove him. Interestingly if you read the constitution carefully I could be wrong. Ramaphosa gets elected president ANC. Then the deputy becomes president of SA. They then redeploy the deputy to Luthuli house. BOOM RAMAPHOSA WILL BE PRESIDENT AGAIN for a 3rd term. Perhaps I read it wrong but legal experts can let us know. Only people who do not want Cyril as president is Jacob Zuma and Julius Malema. and Zimbabwe. I shudder to think what Jacob Zuma would do on the next round. First wasted 9 years about a trillion looted. President Cyril Ramaphosa may not have got certain things right, but he stabilised the country. Now wait for the GNU led by Ramaphosa like never seen.Rama we support you, you the only hope but start cracking the whip.
