This is happening in New York right now.
I don’t feel safe entering my own property alone.
I can’t even access my own basement without posting notices
and waiting for permission —
from the person who took my property using fake documents and a bounced check.
I am the legal owner.
I pay the mortgage.
I pay property tax.
I pay insurance.
I pay for maintenance.
And yet —
I have less control over my own property
than the person who committed fraud to get inside.
For 8 months, I’ve been in Housing Court —
fighting someone whose identity may not even be real.
And every agency tells me the same thing:
“This is a civil matter.”
If I want it treated as fraud,
I have to hire another lawyer.
So let me ask:
If someone can use fake documents to take your property —
and live there for free for 8 months —
what does ownership even mean in New York?
And how many other people is this happening to?
Now let me ask one simple question:
If the situation were reversed —
If I, as a landlord, collected 8 months of rent
and refused to give someone the keys or access —
Would this still be called a “civil matter”?
Would the police tell the tenant to go hire a lawyer
and spend thousands of dollars just to get their money back?
Or would I be arrested for fraud?
Because we all know the answer.
So why is it different when the victim is the landlord?
