The actual proposal is very different from what the headline reads. A lot of panic is being spread on this and it is based on not reading the entire provision and not understanding where this change is proposed. Let me try to explain. Section 132 of the 1961 Act relates to "Search and Seizure". The powers under section 132 cannot be invoked at the drop of a hat or at the whims and fancies of an individual officer. This what is often called "a Raid" in normal usage. Section 132 gives power to officer above the rank of "Joint Commissioners" ONLY in case where "consequence of information in his possession, has reason to believe that" a person has money, bullion, jewelry or other assets which are not disclosed to authorize an officer to enter any building and search AND "break open the lock of any door, box, locker, safe, almirah or other receptacle for exercising the powers conferred by clause (i) where the keys thereof are not available". This is not a power to be taken lightly and cannot be used without appropriate approvals. Now what the Income-tax Bill, 2025 does is to extend this to "Virtual Digital Space". So the new proposal empowers the same authorized officer ONLY in the event of a valid search "consequence of information in his possession, has reason to believe that" there is undisclosed income. What is in section 132 of the 1961 Act is expanded in section 247 of the ITB, 2025 given the changed circumstances to " break open the lock of any door, box, locker, safe, almirah, or other receptacle for exercising the powers conferred by clause (i), to enter and search any building, place, etc., where the keys thereof or the access to such building, place, etc., is not available, or gain access by overriding the access code to any said computer system, or virtual digital space, where the access code thereof is not available" While breaking open your almirah was not a violation how can overriding your computer system to see your emails be a violation?? I am giving a link to my earlier thread on "Raids" and how much work is done before it. The same needs to be done here. The safeguards against misuse that is spoken of below exists.
