Guess what—the tragic events that occurred yesterday could have been completely avoided had Pretti made one less dumb decision. But here’s what seems like the MOST plausible explanation as to what happened given all the footage and evidence that’s been released: — Pretti was impeding law enforcement operations then proceeded to resist arrest and get into a brawl with law enforcement while armed with a gun. — While Pretti was resisting arrest, officers noticed his weapon and screamed out that he had a gun. — Pretti was disarmed by one officer who takes his weapon. — Pretti reaches for his gun in his waistband, but grabs one of his secondary magazines since he was disarmed. — Pretti’s weapon negligently discharges as the officer who disarmed him walks away with the weapon (the Sig P320, Pretti’s weapon, is notorious for NDing). — This triggered the other agents to think that the man on the ground, Pretti, had begun shooting, so they neutralised the perceived threat. All happening within a matter of seconds… IF this is the case, and this seems like the most plausible theory to me, it was a tragic accident. Anyone who tells you this was an “execution” is simply trying to stoke the flames of these riots and they will get exactly what they want—more death and destruction.

“He was directing traffic.” Why was he directing traffic? He’s not a cop. It seems very likely he was “directing traffic,” in order to assist an organized mission to impede federal agents. That’s a felony. He likely chose to commit a felony while armed.

Very smart move by President Trump to send Tom Homan to Minnesota to find a way to ensure the worst of the worst and those criminals detained by state and local authorities in Minnesota that present a threat to the public are turned over to federal authorities, as required by U.S. law. Sanctuary city policies need to end. They entice future illegal immigration, they are gateways to massive fraud and eventually lead to a breakdown of law and order. I am glad to see Tom is back in the game because we need a new set of eyes and someone with his experience to help turn around the problems of the moment and the future. Tom is the right man to find a way to de-escalate the situation.

Up in the night researching and reading a couple Supreme Court cases about the use of deadly/excessive force by officers. Here is what I learned: Whether we personally think the shooting of the armed protester was justified or not. That is not how the law works. In a court of law, the officer would be evaluated under the Supreme Court’s 1989 ruling in Graham v Connor which established the “objective reasonableness” standard for use of force. That standard is very clear. Use of force is judged from the perspective of a reasonable officer on the scene, in the heat of the moment. Not with hindsight. Not with slow-motion video. Not with information that only becomes available after the incident is over. Courts are instructed to consider: • the seriousness of the suspected crime • whether the suspect posed an immediate threat • whether the suspect was resisting or attempting to flee The court explicitly acknowledged that police officers are required to make split second decisions in tense, uncertain, and rapidly evolving situations. The law does not demand perfection. It does not require officers to wait until they are harmed. And it does not allow public outrage or carefully selected footage to redefine legality after the fact. We can debate morality all day. The legal standard is settled. And I personally agree with it. It makes sense considering the nature of their jobs.
