Colorado is faced with a profound test of its commitment to justice, transparency, and the rule of law. The continued imprisonment of former Mesa County Clerk Tina Peters is not simply a matter of legal technicalities—it is a question of whether good‑faith public service can be criminalized when it challenges bureaucratic norms. At the heart of this case is intent. Peters did not act to manipulate votes, alter outcomes, or undermine democracy. She acted out of a stated obligation to preserve election records, consistent with federal requirements mandating that such records be retained for 22 months. When she permitted a forensic image of voting systems to be created, her goal, by all available accounts, was to ensure that critical audit trails and digital logs were not lost during a “trusted build” process that risked overwriting them. That distinction matters. Criminal law hinges on wrongful intent. Yet Peters has been treated not as a public official navigating a complex and potentially conflicting regulatory environment, but as a deliberate wrongdoer. This framing ignores a central reality: election officials often operate at the intersection of federal mandates and state procedures that do not always align. When those obligations appear to conflict, preserving records—the very foundation of transparency—should not be treated as a crime. Equally troubling are the unresolved questions about whether key evidence was fully considered. Claims that system logs were being overwritten, and that this supported Peters’ rationale for preserving records, raise serious due‑process concerns. Under Brady v. Maryland, defendants are entitled to exculpatory evidence. If such evidence was minimized or excluded, then the integrity of the conviction itself is called into question. The punishment imposed is also wildly disproportionate. Peters, a 70‑year‑old public servant, now sits in prison for what can reasonably be understood as an administrative decision made in good faith. This is not justice—it is an overreach that sends a chilling message to election officials everywhere: raise concerns, question procedures, or attempt to preserve records beyond the minimum, and you may face criminal prosecution. That message undermines, rather than strengthens, public trust. Confidence in elections depends on openness, scrutiny, and the willingness of officials to ensure that records are preserved and systems can be audited. Punishing those who attempt to do so risks silencing exactly the kind of diligence the public should expect. Governor Jared Polis has the constitutional authority to correct this injustice. Clemency—whether through a pardon or commutation—is not an act of partisanship; it is an act of principle. It would acknowledge that intent matters, that proportionality matters, and that the justice system must remain anchored in fairness rather than rigidity. Releasing Tina Peters would not weaken Colorado’s election system—it would strengthen it. It would affirm that transparency is not a crime, that good‑faith actions deserve protection, and that justice in Colorado is guided by reason, not retribution. The state should act—and act now.
