BREAKING: Landmark report finds former Royal Gibraltar Police Commissioner Ian Mcgrail was forced out by grossly improper interference in live criminal investigation by Chief Minister; the process used against him was defective, unfair and unlawful. Ian McGrail, the former Commissioner of the Royal Gibraltar Police (RGP), has welcomed Sir Peter Openshaw’s landmark report - for Gibraltar, police independence and the rule of law. He will be speaking at a press conference at 3pm UK / 4pm Gibraltar, live on @GBCNewsroom. Sir Peter Openshaw, a retired UK High Court Judge, was appointed in 2022 to investigate why Mr McGrail retired from his post after 35 years in the RGP. In the thread below I set out key findings in the report with some screenshots of the report itself. KEY FINDINGS IN THE REPORT 💥Mr McGrail was “forced out”. One of the main reasons he retired was that the Chief Minister, Fabian Picardo KC, “was machinating against him, including by putting improper pressure upon him to alter the course of a live criminal investigation” (see paragraphs 12.370 and 12.380 of the Report). 💥All allegations that Mr McGrail was dishonest or acted improperly were rejected: “He did not lie”; “it would have been completely out of character for [him] to be deliberately dishonest” (see paragraphs 0.183, 0.191, 8.166 and 11.130 of the Report). 💥The Chief Minister made a series of “grossly improper” and “sinister” interventions into a live criminal investigation, impacting on the national security of Gibraltar, to protect his friend and business partner James Levy KC from a search warrant (see paragraphs 11.85, 11.87, 11.257, 1.305, 11.311, 11.350, 11.316, 11.320, 11.332 and 11.356 of the Report). 💥Nick Pyle, Interim Governor and FCDO diplomat, “enthusiastically” supported the plan to remove Mr McGrail, but failed to investigate Mr McGrail’s “extremely serious allegations of political interference in an ongoing police investigation” before instigating a “defective” and “unfair” process; Mr McGrail “retired only because he felt he was being unfairly and unlawfully compelled to do so” (paragraphs 12.183, 12.221-12.222, 12.218, 12.382, 12.385 and 12.389 of the Report). 💥The Chief Minister “deliberately and cynically” misled the Gibraltar Police Authority about the reasons for his loss of confidence in Mr McGrail, and deliberately suppressed the link to Mr Levy, Hassans and 36 North (see paragraphs 12.104, 12.138, 12.178 and 12.251 of the Report). 💥“The inevitable and irresistible conclusion is that Mr Picardo was using the processes of the GPA to bring about Mr McGrail's effective dismissal for reasons of his own, relating to the police investigation into Mr Levy, whilst managing the process so as to give the appearance that he was being asked to retire for other reasons, namely the Incident at Sea and the HMIC report” (See paragraph 12.179 of the Report). 💥 “I have no doubt that the real reason for Mr Picardo's loss of confidence was that Mr McGrail and the RGP had obtained a search warrant against his friend Mr Levy, which he was determined in one way or another to thwart” (see paragraph 12.369 of the Report).




Full Reply on the extremely grave findings by Sir Peter Openshaw that Mr Picardo made a “grossly improper attempt to interfere in a legitimate police investigation and operation.” Each Minister now needs to decide whether to back or sack him. If they back him they own this too
