Also, just an FYI Jumping an OOS Order is a federal violation, and not a crime under federal regulation “FMCSR’s” This pertains to not only roadside OOS Orders but also administrative OOS Orders for an entire company Jumping a roadside OOS Order is a misdemeanor in many states, but not all. 🤷‍♂️ Jumping an administrative OOS order is only a violation in the FMCSR’s and not a state crime in any state.

1. AHP are the state law enforcement officers that hold responsibility for, and operate all scales in Arkansas. They are not the Arkansas State Police. Their main focus is the enforced state and federal CMV regulations, although they can enforce all state law. 2. AHP is authorized to pull over and inspection ANY CMV physically present in the State of Arkansas. Probable Cause is not required, because it is a regulatory inspection. Inspections can include everything from weight violations to equipment, driver, & documentary violations. 3. Should a driver that is under an OOS Order violates said order, he has committed a federal offense. He could also face state charges for violating the order. Either would be a jailable offense, plus revocation of CDL privileges for up to 5 years.
