DPP moves to Supreme Court to challenge Court of Appeal Ruling on Cybercrime Law. The Office of the Director of Public Prosecutions (ODPP) has filed a petition before the Supreme Court of Kenya challenging the judgment of the Court of Appeal at Nairobi delivered on 6th March 2026, concerning the Computer Misuse and Cybercrime Act. In its petition, the ODPP expresses dissatisfaction with the appellate court’s decision which declared sections 22 and 23 of the Act unconstitutional on grounds of overbreadth. Through the petition, the ODPP seeks to have the Supreme Court overturn the appellate court’s Judgement. The ODPP remains committed to executing its constitutional mandate in accordance with the rule of law, public interest and administration of justice. #HakiNaUsawa
