Let's follow your logic of the "pure fabrication" scenario to its conclusion.
One week before facing an investigation where he would failed to convince the Australian tax office that he actually controlled hundreds of thousands of Bitcoins, Craig Wright reaches out to Louis Kleiman.
He writes to this old man, unsolicited, and tells him an elaborate story about his son's central role in the invention of Bitcoin and his control over hundreds of thousands of coins.
To achieve what, exactly?
Why would Craig Wright wrote to Dave's father for the first time when having to prove control of these Bitcoins unless he knew at least part of that control might have been in this person's hands?
Now consider the broader timeline.
In February 2011, just two months after Satoshi Nakamoto's final public activity, Dave Kleiman incorporated W&K Info Defense Research LLC in Florida.
This company was registered before the general public knew or cared who Satoshi was. This was before the Silk Road, before the price made the coins worth anything significant, before any tax scheme could have been conceived, because there was nothing yet to scheme about.
Our question to you is the following:
Who, in February 2011, incorporates a company to hold cryptographic intellectual property (later valued in court at over 100 million dollars) and manage assets related to Bitcoin?
Someone who was closer to its origins than a “pure fabrication” would suggest.

Mr Justice Mellor did not say that evidence post-2016 was excluded from consideration, nor did he rule that pre-2016 descriptions of Bitcoin must be disregarded or that only post-2016 characterizations were permitted.
In the main judgment in Crypto Open Patent Alliance v Wright ([2024] EWHC 1198 (Ch)), handed down on 20 May 2024 following the trial on the identity issue (whether Dr Craig Wright is Satoshi Nakamoto and created Bitcoin), the court thoroughly examined evidence spanning the full relevant period. This included:
🔸Pre-2008/2009 materials (e.g., precursors to Bitcoin concepts, the White Paper published in October 2008, early source code, and the Genesis Block in January 2009);
🔸Wright's claimed pre-2016 documents and "Reliance Documents" purporting to show his early involvement;
🔸2016 events, such as the private "proof sessions" (demonstrations of alleged access to early Bitcoin keys) and the public "Big Reveal" in May 2016 when Wright first asserted he was Satoshi;
🔸Post-2016 materials, including later code changes, witness evidence, expert forensic analysis of documents, and Dr Wright's own statements or actions.
The judgment assessed all this evidence on the balance of probabilities. It did not impose any blanket exclusion or cut-off based on 2016 (or any other date) for descriptions, definitions, or characterizations of Bitcoin, the Bitcoin system, the White Paper, or related concepts. Instead, Mellor J focused on the reliability of the evidence.
Key points from the judgment relevant to evidence handling:
🔸Many of Dr Wright's documents claimed to be from pre-2008/2009 (or otherwise early) were found to contain anachronisms (e.g., references to technical features or terms introduced years later, such as certain code functions from 2013–2014, "UTXO" concepts solidified post-2012/2013, "Bitcoin Core" terminology from 2014, or software/fonts not available until 2010–2012 or later). These made the documents unreliable or forged, so they were given no weight as proof of early authorship or involvement.
🔸 Forensic experts identified metadata manipulations, backdating, and other indicators of forgery in numerous documents relied upon by Wright (often created or altered in 2016 or much later, including some in 2023). The court found forgeries "on a grand scale" and excluded reliance on those tainted documents.
🔸 Reliable contemporaneous or independently verifiable evidence (including from the actual early Bitcoin period and expert technical analysis) was prioritized. The White Paper itself was determined to have been produced in OpenOffice 2.4 (consistent with 2008), not in the LaTeX setups Wright later claimed.
The overall conclusion was that the evidence was "overwhelming" that Wright is not Satoshi Nakamoto, did not author the White Paper, and did not create the Bitcoin system. His supporting evidence was deemed fabricated or of "very dubious relevance," while COPA's case (including from developers and technical experts) was accepted.
The court did not "edit" or sideline history by excluding pre-2016 material in favour of a "curated present." It admitted and weighed evidence across timelines but discounted Wright's submissions where they were unreliable, forged, or anachronistic. The 2016 date features prominently mainly because that is when Wright first publicly claimed to be Satoshi (after earlier media speculation) and conducted the disputed proof sessions—events the court scrutinized as part of the broader factual matrix, not as a dividing line for what could be considered.
No part of the published judgment (main reasons judgment or subsequent relief/contempt proceedings) contains anything that could be described as excluding any description of Bitcoin prior to 2016 from consideration. The proceedings focused on the identity/authorship issue and related IP claims, with extensive technical and documentary analysis of Bitcoin's actual early history and development.

@_Eph91_ There's no KYC needed to determine spam. Basically, spam is everything that is not defined as a legit, native Bitcoin financial transaction. Most of these data spam transactions have several certain earmarks based on which they can be rejected.

There has been some news on the Faketoshi02 and 03 opposition appeal cases, which were filed over a year ago. The appeals have been given numbers T 41/25 and T 357/25 and the composition of the Board has been decided. Next step should be either a summons to oral proceedings or a preliminary opinion, or maybe both. This may take a few more months though.
