Yesterday’s Supreme Court judgement on denying ‘SC Status’ to Christians, Muslims and other minorities has caused deep consternation, disquiet and fear amongst the poor in minority communities. The determination of ‘Status as SCs’ (even as Backward Classes) on conversion has been a sensitive issue impacting large number of poor, underprivileged and those seeking to end the societal prejudice. The issue can not be examined or opined upon on simpliciter interpretation of the Constitution (Scheduled Castes) Order, 1950. Certain Fundamental issues must be addressed and answered -: 1. The issue of grant of/continuing ‘Status of SC’ on conversion is pending before a 3 Judges Bench of Supreme Court since 21/1/2011. (Centre, Public Interest Litigation V/S Union of India, Write Petition 180 of 2004) Then, how can a 2 Judges Bench of Supreme Court decide the issue, without reference to larger bench? 2. Why did the Modi Govt not bring this to the notice of the Supreme Court Bench regarding issue being under adjudication before a 3 Judges bench? Was it done deliberately by the Government? Why did Modi Govt not apprise the Supreme Court that the Supreme Court has framed specific issue of examining SC Status for converts on 21/1/2011? (See the Court Order below) Why did the Modi Govt not inform the Supreme Court that under directions of the Court, a Commission headed by Former Chief Justice of India, J. Balakrishnan has been constituted in the Year 2022 to examine this very issue and the Commission is yet to submit its report ? Then, how can the issue be pre-decided ? Is this not sheer dishonesty and deliberate misleading of Court by the Government? 3. Is it correct to say (as is being said by some in Govt) that the case in Supreme Court related to applicability of SC Prevention of Atrocities Act and not reservation? Such an argument is dishonest, bordering on stupidity. Can a person be Scheduled Caste for purposes of ‘reservation’ and a ‘non Scheduled Caste’ for purposes of SC Atrocities Act? Will this compartmentalisation sustain? 4. Does the prejudice of BJP Govt emanate out of its stated political position of denying benefits of all reservation to minorities ? 5. Is the prejudice of Modi Govt guided by the previous conduct of BJP, when it bitterly opposed in the Parliament in the year 1996 a move to include convert Christian Scheduled Castes in the category of SC’s or when it rejected J. Ranganath Misra’s report in the Year 2022, which had recommended SC benefits for Christian and Muslim SC’s too ? 6. Once those Hindus, who converted to Sikhism or Buddhism continue to be recognised as SC’s, a simple question then arises if it is fair to deny equal treatment to Christians or other Minorities? 7. Is the ‘determinant’ of ‘social & cultural backwardness’ “religion” or something more in order to qualify for the protection under Articles 15 & 16 of the Constitution ? Does ‘conversion’ alone take away all the symptoms of ‘generational social stigma & prejudice’ associated with being a Scheduled Caste ? In effect and reality, Is there no disadvantage or stigma or prejudice or inequality suffered in practice by those poor and disadvantaged SC’s, who converted to Christianity or Islam or other faiths ? Are these the tests that should be examined, considered and determined (both based on empirical data and Constitutional touchstone) before denying the benefits to convert SC’s ? 8. Is this a prelude to denying all reservation benefits (as SC or BC) to the Minorities in the country? THE PRIME MINISTER & THE GOVT MUST COME FORWARD AND ANSWER !

Denial of SC status to Dalit Christians is injustice. Caste is birth-based graded inequality, not erased by conversion. Forcing Dalits to stay Hindu betrays Ambedkar's vision: Hinduism is a chamber of horrors, sanctifying inequality via Chaturvarna & Manusmriti.
