@JBSDC But it’s also true that the CFTC has largely chosen not to exercise its rule 180.1 powers for insider trading cases, at least thus far. Especially in cases that don’t involve clear manipulation/fraud, the CFTC has been quite restrained, which is notable compared to SEC.

Hey @mattyglesias and @brianbeutler, it’s me, your favorite former General Counsel of the Commodity Futures Trading Commission! I appreciated your discussion of oil futures on this week’s podcast. To your point about trading on non-public information, the Commodity Exchange Act and the CFTC’s regulations do prohibit insider trading in somewhat the same way as the securities laws do. In the case of commodity futures, that includes government information. I’d be happy to explain. Please let me know when you are next recording. Cheers!

@ohaiom @dbarabander CFTC may be “watching”, and they do have the authority to investigate, but thus far there’s been very little indication that they’ll actually take action. Insider trading and market manipulation laws in derivatives markets speak quietly compared to in securities.

Something this WSJ piece omits is that what @brian_armstrong is arguing for is not obviously in Coinbase's interest: in a world where yield sharing is prohibited, USDC will at least in a first-order way be more directly profitable for Coinbase. As far as I can tell, Brian's position stems from his belief in the importance of a vibrant and competitive market that protects consumer liberty, and I think he deserves a lot of credit for that. wsj.com/finance/curren….
