I am certainly not a legal expert however as I have seen it, the courts have generally given very broad leeway to defamation rap "diss" lyrics in general. This is true of the battles between East and West Coast, the Rap battles between Drake vs. Kendrick Lamar etc. They consider the lyrics to be "non-literal opinion, rhetorical hyperbole" which definitely applies here. It's actually very reasonable to assume that most people who heard the lyrics of this honestly infantile song knew that Afroman was NOT speaking literally about having sex with the officers wife, he was just being a vulgar jerk. IF he had used her name specifically, used a clear picture of her etc - that might have meant he crossed the line of slander/libel, but in general generic references to "your wife" are covered by free speech laws per the courts as far as I know.

No, sorry. He has the right to name the officers all day long, but when he makes claims about the specific positions he claims to have used with the officer's wife, whether the jury was able to be talked into considering it defamation or not, it's immoral, and not to be praised.

The officers are public figures acting in a public capacity. The first amendment right to talk about them has been well established going back to well before the era of 2 live crew where they openly and aggressively insulted the governor and sheriff of Miami by name. Which everyone in Florida (and around the country) played relentlessly and loudly across the state on the 10in woofers in the back of their ride 1 vague reference to "your wife" is stupid a 3rd grade level insult akin to talking about someone's mom on the playground We aren't going end first amendment rights because sometimes words hurt peoples feels. That's the entire reason we need a first amendment. But "some kids were upset" is NOT enough reason to destroy our freedom of speech.

He mentioned one of the officers by name and dedicated a whole song to him (and videos showing his face) in which he claimed to have sexual relations with the officer's wife. Their six children were tormented by kids at school who insisted that Afroman was the father of at least one of them. Most of the sources reporting on this claim that the officer in court said I don't know when asked whether the allegations of the rapper screwing his wife were true, but what he actually said I don't know to was the statement, "but everybody knows he didn't screw your wife, right?" Obviously the officer couldn't confirm that everybody knew that.

Dear Jabba, No one has ever accused you of veganism. In fact, no one has ever accused you of any sort of diet, meal plan, or careful caloric intake. In fact, I know you ate that entire leg as everyone around you looked on in horror. I’m just glad no small children or animals walked next to you because you probably would have consumed them as well. Watching you eat is probably like watching a nature documentary where a whale opens its mouth and everything in the area just falls in. They need to designate you as a natural disaster. No hugs. I was curious, and I listened to and watched the most viral video rap he made about this - "lemon pound cake" - frankly it was very very tame, even towards the police I grew up outside of Miami during the NWA, 2 Live Crew era when they were feuding with the sheriff there over obscene lyrics and everything got a "Parental advisory" sticker. He and the Governor were mentioned by name explicitly, repeatedly - it was all fine. I do think there should be limits, but it would have to be more than a "vague your mamma joke" style reference ie; mentioning your minor child by name/image , or your wife who works/lives privately by name/image specifically - otherwise, meh. It's hard to get too excited protecting someone hurt by words in a song about cake.
