New piece from me on laws banning minors from using chatbots. Minors have a First Amendment right to receive information, and the vast majority of chatbot outputs are protected speech. Full-on bans go beyond protecting minors from obscene material—they're not narrowly tailored.

@jack_g_nicastro I'd argue that the Anthropic ordeal was the administration showing its true colors versus the deregulatory song & dance it does to please its tech right constituents (granted, it's done solid walking back regs & the administrative state re: AI)

This is a sensible approach to regulating AI. Rather than banning minors, the framework aims to protect children via parental controls and safeguards. All three innovation objectives—regulatory sandboxes, federal datasets, and existing regulatory bodies deploying sectoral AI rules—are winners. Federal preemption of state AI laws is crucial, albeit unpopular. But the framework repeats the phrase "Congress should" twenty-six times. Releasing this was the easy part. Now the real work begins: getting legislators to pass these laws.

Today, the @WhiteHouse released a commonsense National AI Policy Framework that ensures every American benefits from AI. As @POTUS has said — we need one federal AI policy, not a 50 state patchwork. This gets us there. Eager to work with Congress on this important legislation.

@AndyJungTech But it doesn't say it is demanding that. It says that's the goal. It says its strategy is to prevent government from imposing ideological bias.

The inherent tension in Trump admin's approach to AI and 1A: AI Action Plan: "AI systems must be free from ideological bias and be designed to pursue objective truth rather than social engineering agendas when users seek factual information or analysis." AI Policy Framework: "Congress should prevent the United States government from coercing AI providers to ban, compel, or alter content based on partisan or ideological agendas."

"If a reasonable person that interacts with an AI companion..." Define reasonable person here. In a world in which there's such a varied level of AI use and literacy, I think this inquiry is being overlooked by lawmakers employing this or similar language.
