NEW: Police have released more info about the "Harry Dresden" break-in in Fairfield, CA, say both the homeowner & Nichols sustained head injuries.
Police are praising the "actions of the homeowner" who raced home to confront 30-year-old Jason Nichols with a shovel.
Authorities say that the homeowner's wife and child were inside when Nichols broke in. When Nichols was unable to break in through the front door, he broke in through a sliding glass door.
"The homeowner's husband, who was away at the time, observed the suspect through a home security camera and immediately returned to the residence," said police.
"As the suspect entered the home, the homeowner returned, armed himself with a shovel, and confronted Nichols."
"A physical altercation ensued, during which both the homeowner and Nichols sustained head injuries."
"We are grateful that the family is safe and commend our officers for their swift response in bringing this dangerous situation to a safe resolution."
The woman and child were reportedly unharmed.

Reaching for his firearm even though it wasn't there shows criminal intent. Now did he have the means to shoot anyone at the time? No. But it proves he was intending to. The officer that grabbed his gun out of the holster should have loudly announced he removed the firearm. I didnt hear that in the videos. When the officers heard the shot they should have assessed where the shot came from before immediately shooting the suspect. The 5-7 shots after the suspect was flat on the ground with nothing in his hands were clearly excessive. But its a split second situation with several humans moving around, alot of noise, below zero temperatures, and high levels of adrenaline. Its not crazy to imagine they heard the word gun, saw a holster, heard a gunshot in the area theyre wrestling with a suspect and then assumed he fired the shot at them. They assumed wrong and should be disciplined but I dont think they intentionally shot an unarmed man.

What’s your opinion on how this should be handled ? Policy wise for ICE and consequences for said agents involved ?

Carrying a firearm is not a death sentence, it’s a Constitutionally protected God-given right, and if you don’t understand this you have no business in law enforcement or government.

If you approach law enforcement with a gun, there is a high likelihood they will be legally justified in shooting you. Don’t do it!
