About a year ago, I swore an oath to support and defend the Constitution of the United States. I’ve sworn this oath twice before, but there was something very special doing it as an Assistant US Attorney. I will never forget the importance of my promise to the country I love.

@LinkofSunshine And even if you take their data at face value without accounting for the coding error, it’s only something like 20% of men leaving. Which means 80% stay, which is…still really good?

I often see people quote a study about men leaving their wives when they get sick. However, that study was completely retracted for a coding error that nullified the result! In response, they released a super p-hacked result lol

@stacey_hauff My money’s on a combination of raccoons and coyotes. Heard a lot more coyotes when I lived in Cleveland, but I’ve heard them in Cbus too.

So I’m a scaredy-cat but I think this one is warranted. In the middle of the night I woke up to something outside making these spooky noises. My cats were completely freaked out too. I asked my friends today and we cannot decide who/what this was!

@ItsMattsLaw Pretty much everything…Supreme Court precedents relate to humans and therefore do not clearly establish Paw Patrol’s liability.

Crazy times out there, but a little storm rolled through and dusted us with some rain. Son ran out in the rain, initially told him to come in, then said have fun buddy. He came running in soaking wet excited to report that our tomato plants finally took hold and had sprouted into the lattices, they will soon take hold. They know nothing of the crazy out there. Happy kids. And it's moments like that where you realize that you must believe that everything will be ok, and that you are doing things right. We ain't doing it for us, we are doing it for them.

@groopadot @homegymcoop I would argue it’s still ordinary negligence, which could be waived. But there are certain scenarios where it arguably becomes recklessness and can’t be waived (eg gym staff saw the machine come a little off the ground on several occasions before).

@BMB_Esq @homegymcoop Appreciate the response! If the manufacturer's instructions/specifications state that the machine must be bolted down, and yet this one was not, is that a level of negligence that can be waived or a level of negligence that can't be waived?

This is a perfect example of why buying cheap equipment can often end in a bad day. Every functional trainer should have the ability for the full stacks to be in use without this happening. Even without being bolted to the ground.

@groopadot @homegymcoop If they have a decent waiver, should be okay as long as they didn’t have prior notice that the machine could tip over like that.
