I gather that folks here are aghast at the prospect of court packing. But let’s be honest, isn’t it an imperative if you’re on the left? What, you think the other side is going to take a lifetime of getting their teeth kicked in? Some kind of court smashing is inevitable.

@ProfDBernstein Well if it’s the same Congress that did the packing, they could presumably take away clerks, the Supreme Court building, and send them to the most dimly lit basement of the Capitol to do their work.

To be more explicit: the point of many regulatory requirements (including inside gov’t) is to force people to do cognitive work that they might otherwise avoid and that is likely to change how they do things. If that work is turned over to AI, it becomes pointless.

One goal of New Deal regulation—and I’m thinking of the SEC in particular—was to bend internal firm culture toward the public interest. I’m inclined to think this worked at least somewhat, but is likely to be blunted as firms turn over regulatory compliance work to AI.

Virginia voters have spoken, and tonight they pushed back against a President who claims he is ‘entitled’ to more Republican seats in Congress. As we watched other states go along with those demands without voter input, Virginians refused to let that stand. We responded the right way: at the ballot box.
