After the City of Augusta responded with blanket “no records responsive” replies to six separate FOAA requests, Kennebec County Administrator Scott Ferguson stepped in and forcefully centralized the entire process. He directed that ALL FOAA requests on this matter must go through the County and that responses would be managed and answered by the County. However, the County is now replying that they are not in possession of many of the key records — including ME-RAP board rosters and minutes, payments and benefits to Courtney Gary-Allen, Jon Reynolds, Raegan LaRochelle and Tess Parks, Microsoft Teams recordings, and detailed Access Center funding sources. They repeatedly state these are “internal management records” of the non-profit ME-RAP. Here’s the irony: The County has taken full command and control of the FOAA process… yet they are disclaiming responsibility for producing most of the actual records the public is entitled to see. This has created a great deal of confusion about who is truly responsible for these public records. I’ve sent a polite follow-up asking for clear guidance on the proper legal custodian so I can proceed efficiently. It feels like circling the wagons, but we'll see.
