Nikita Singhania had kept the child’s location hidden for weeks after Atul’s death. The child was found in a boarding school in Faridabad Haryana. The Supreme Court gave custody to Nikita. The criminal case against Nikita has been adjourned to November 2026. Anju Devi’s son is gone. Her grandson is with the woman accused of abetting his death. She has no legal right to demand visitation. In India grandparents have zero legal right to meet their grandchildren. No law. No provision. No recourse. India has laws for everything. It has nothing for a grandmother’s grief.

Yes, we always say — Divorce is just a piece of paper. So why men beg in courts for that toilet paper? Most Indians don’t even register their marriage. Most don’t even have a proper marriage certificate. And the irony? Most women don’t even change their surname after marriage… but will still demand ownership of the husband’s property. If marriage itself is barely on paper… Then why men drag themselves to court for “divorce” — and force themselves to pay huge amounts for that same toilet paper?

@imra_mra Indian courts are living in yester years. They are not ready to accept reality that marriages are breaking quite often now a days. They need to decouple family disputes from current process which deems husband & family as criminal to begin with.

I have never read such a disgraceful and absurd order in my life. Whenever a court decides on a conviction in any case, it specifies the basis for the conviction. In this case, the court accepted the complainant’s story as true and proceeded to convict the accused. Ironically from the complainant’s side nothing came on record except a narrative there was no evidence at all. The court failed to understand why the other 5 accused in this same case were dropped after investigation. The court also didn't realize that this entire 498A case was initiated only after the husband filed for divorce. In her testimony, the complainant herself admitted that she had no evidence to prove either physical or mental cruelty. The court completely ignored this vital fact. The court completely overlooked the contradictory statements from the complainant and her side. The court added IPC 34 to this case, which was neither part of the cognizance nor the charge framing. The complainant alleged that her husband had a relationship with another woman, which the court accepted as true without any evidence. The husband of the said woman appeared before the court and testified against the complainant, but his testimony was ignored. The court labelled the witnesses produced by the husband most of whom were independent as biased in favour of the husband. At the same time, it accepted the statements of the complainant, her sister, and her father as truthful. (Why would a complainant’s father or sister ever depose against her?) Another important aspect of this case is that the complainant did not mention the date, time, or even the month of any alleged incident. According to the court, this was natural. (If a husband breaks his wife head, how can she forget such an incident? She remembers neither the date, nor the time, nor the month and on top of that, there is no medical evidence.) According to the complainant, she was harassed for dowry immediately after marriage, yet the complaint was filed more than a year later. The court treated this delay as a normal and acceptable circumstance. I am fully confident that this judgment will be set aside by the Sessions Court. Yesterday I attended the wedding of a known, an older didi who’s getting married for the second time. She’s around 40, I think, and already has a 17 year old son from her first marriage. The man she married this time is much younger, about 30, and earns comparatively less since he works as a bodyguard, while she comes from a wealthy family; her father is a government contractor. At first, I thought it was nice that she was getting married again after her divorce and hoped she would finally be happy. Later, I found out that her ex husband wasn’t even willing to give her a divorce, and the case went from the family court to the high court. Her son, whom I mentioned earlier, is reportedly differently abled maybe cerebral palsy, I’m not completely sure. They also have a daughter. To my surprise, I learned that she left both of her children in their father’s custody and went on to marry this young man. On the other hand, her ex husband has also remarried, to a woman who already has three daughters. I honestly felt awkward and a bit sad thinking that this poor man now has to take responsibility for six other people while she’s free from all her responsibilities.
