@GaboxRox15 @EricEstepp17 He didn’t need to be. He just needed to be ahead of Bell. There’s a difference between checkers and chess.

@Jeff_Bluck @caleb_michel @Jordan_Bianchi Well, it wasn’t before the trial (cuz NASCAR execs are morons), but as expected, NASCAR settled. The teams now have the permanent charters they deserve. HMS/Penske/JGR all owe Denny, MJ, and Jenkins for having the balls to fight this fight.

@Jeff_Bluck @caleb_michel @Jordan_Bianchi Could teach a masterclass in selective reasoning. Quite the impressive display of belief over evidence. I’ll agree to disagree, as your cognitive dissonance prevents a reasonable discussion. But, I’ll keep this receipt, so we can revisit when the details of settlement are known.

In a new filing pertaining to the 23XI/Front Row case, NASCAR asks the court to order a judicial settlement conference and "order the parties to participate, and appoint the magistrate judge assigned to this case or another judicial officer to preside over a conference to be scheduled at the convenience of the Court." Teams would prefer to continue using a court-ordered mediator.

@bobpockrass All NASCAR had to do was negotiate in good faith with the teams and arrive at a more equitable deal. Instead, they chose to bully and flaunt their power. They may end up paying hefty price as a result.

Judge Bell: "NASCAR made a strategic decision in asserting its Counterclaim and must now live with the consequences. ... NASCAR wants to (but cannot) have it differently on each side of the same coin – heads we win, tails you lose."
Bob Pockrass@bobpockrass

The judge said b/c NASCAR's counterclaim identified the market as "the market for entry of cars into NASCAR Cup Series races in the United States and any other location where a Cup Series race is held" that NASCAR couldn't say that's not the market for the 23XI/FRM allegations.

@_TaylorKitchen_ We repeatedly see this inane logic used by losing crew chiefs. When you are obviously the fastest car, the call should ALWAYS be to match your closest competitors’ strategy (if you have the info). They knew Larson took 2. Taking 2 would’ve won him a championship. Knuckleheads smh

Chris Gayle says he hates that it came down to some chaotic late race restart where they were the dominant car and didn't get the win. He believes four-tires was the right call, they just didn't get clear on the bottom on that restart:

@Brian_McComb @Hapnotes @dennyhamlin Smh all but one race the champion has won the final race. So most likely you do have to win the race to win the championship. Clearly you haven’t watched all of them since 2014.

@EricEstepp17 Never, in the history of professional sports, has a championship been watered down so much to be so meaningless. NASCAR should be embarrassed.

Of all the exhibits with fiery talk and anger, this one stood out for its approach. This May 2024 from Heather Gibbs to NASCAR leadership after a meeting with them and her view on why teams should get permanent charters:

@bluedog373 @1TimothyA @bobpockrass That’s an awfully low bar…. NASCAR doesn’t need 40 cars, it needs 40 viable businesses. Filling the grid is optics; fixing the economics is survival.

@bluedog373 @1TimothyA @bobpockrass Uhhmm, I sat in the 1/2 empty stands at the Kansas playoff race this year and last, bro. Riley Herbst has a full-time ride on Cup. 11 teams have folded in the past 9 years. Yeah, you’re right. No need for improvement here🙄

@bluedog373 @1TimothyA @bobpockrass Absolutely correct. With the current backwoods and myopic ownership and revenue sharing model, NASCAR will never reach the level of more professional sports. It will never garner the interest of serious investors whose capital and adeptness could take NASCAR to that next level.

@1TimothyA @bobpockrass Why does everyone insist on comparing stock racing or any racing to the NFL etc. They are not the same. Never have been never will be. Nobody starts an NFL team as hobby.

@AlmurH @bobpockrass @dennyhamlin This 👆. Anyone blaming charters doesn’t seem to get it. Without HMS/JGR/Penske burning cash to keep the show alive, there is no NASCAR... Lose even one, and the whole house shakes. The fact that it could happen kills new investment before it starts, holding everyone back.

@bobpockrass @dennyhamlin This is the best reasoning I’ve seen for the legitimization of the NASCAR enterprise. No other organization would keep draining the very lifeblood that supports it.
