Sixteen years ago today, Shannan Gilbert disappeared after a harrowing 911 call.
Reflecting on Shannan and all that has unfolded since her disappearance and eventual discovery, it becomes clear that her legacy is so profound, so far-reaching, that even the simplest tribute can speak volumes.
Of the many words that could describe Shannan, one rose above the rest for me:
Transcendent
"Transcendent" explains that her story rises beyond the immediate tragedy, that her impact, the awareness it brought, and the ongoing pursuit of truth and justice extend beyond her individual circumstances.
Her name truly says so much, so for this year, I honor Shannan by just saying her name: Shannan Gilbert.

My take: This is an extremely good reply brief. They deftly parry the State's waiver arguments, call out the State's backward logic, and reorient the court to the complete lack of adversarial testing of the State's case the jury got to hear.
Very much looking forward to the oral argument - yes, I am confident it will be granted.

The original seal was intact with Payne’s initials on it and he is who placed the item in the envelope. If needed, each subsequent officer that handled the evidence bag throughout it’s pre-litigation journey would have testified as to their respective handling of the evidence to establish the chain. While it make viewed as a “weak” chain, it’s a chain nonetheless.
It goes to weight, not admissibility.

This is an embarrassingly misinformed and misleading post. STRMix is one of a number of probabilistic DNA genotyping programs the reliability of which have been successfully challenged in courts due to the impossibility of verifying results without knowing the source code/algorithms which produce them.
Companies treat their code as "proprietary" mainly because they stand to make gobs of $$$ through law enforcement contracts, and perhaps someday broader civilian commercial uses.
As for the DNA profiles, they're referring not to the entire genetic code of 19 million people, but rather the genetic markers at 22 specific locations on the genetic chain -- 22 out of TENS OF MILLIONS. These 22 loci are important because they're the ones that the FBI uses as markers for DNA as a tool of identification/exclusion. That's really all they are -- it's not like you can genetically modify a human being by knowing this tiny fraction of their genetics.
Moreover, these profiles already exist in a database, they can be produced to a defendant without much difficulty, and as requested in the motion itself, other identifying information can be fully redacted. The point of obtaining these data is to independently assess the reliability of the black box program that is STRMix.
Anyway, just your occasional reminder that crap-ass legal reporting is perhaps the main obstacle to criminal justice reform in the United States.
