@Cbejar93Bejar @adamscochran You just proved your own argument wrong, pronouns. Native Americans wouldn't be citizens under the amendment, so it took a later law to grant citizenship. By your own argument, you would need another law (an amendment in this case) to make illegal aliens citizens.

The constitution does not say they are not subject to that nation nor does it say they must only be subject to one nation. It simply says they must be subject to the jurisdiction of the US at the time of birth. Here's an easy test for that: - Does the US have the authority to arrest and detain said person? Yes. Because they are in America and subject to its jurisdiction and laws. If they are here, and subject to our jurisdiction at the time of birth - that's it, that's all the 14th amendment requires. It does not require they be devoid of any other jurisdictions or capacities.

This is getting real. This isn’t some fringe blog post, this is Randy E. Barnett, a Georgetown Law professor, former prosecutor, and one of the leading originalist scholars in the country. They actually believe this. Which raises a bigger question: Will future Supreme Court nominees be vetted on this exact interpretation of the 14th Amendment? Because that’s how you change the Constitution without amending it.
