The Constitution of Zimbabwe, ratified in 2013 following 4,821 exhaustive public outreach meetings across 1,950 wards, enshrines the profound sacrifices and aspirations of Zimbabweans, rooted in the pre-1980 liberation struggle for independence and the post-1980 pursuit of authentic democracy. This COPAC-led process, spanning 105 days, united farmers, students, mothers, workers, and youth in a wave of hope and solidarity, forging a robust framework for rights protection. Drawing from the indomitable spirit of both the pre-independence liberation and post-independence democratic efforts, it culminated in a triumphant referendum, where everyday Zimbabweans from all walks of life delivered a resounding 95% approval. In a profound betrayal, ZANU-PF’s Amendment (No. 3) Bill, H.B. 1, 2026, advances through a mere 64 hearings scheduled from March 30 to April 2, 2026 - averaging fewer than seven per province over four days - constituting a calculated procedural coup that silences millions of voices. The bill audaciously extends terms of office, transfers presidential elections to parliamentary selection, postpones polls until 2030, reassigns voter oversight, overhauls the judiciary, politicizes traditional leadership, and abolishes the Zimbabwe Gender Commission, thereby entrenching state capture and authoritarian control while violating our cherished democratic achievements. This disparity reveals catastrophic democratic decay and regression, eroding pluralism, desecrating Section 67’s fundamental rights to political participation, and setting Zimbabwe’s democracy back by decades. All Zimbabweans must actively confront this malaise, which threatens to consolidate unaccountable power and undermine the 2013 Constitution’s participatory principles. The Constitutional Defenders Forum @cdfzim urges individuals and organizations to engage fully in the public hearings from March 30 to April 2, 2026, by attending provincial sessions, submitting written representations to Parliament (via bills@parlzim.gov.zw or designated deposit boxes), and opposing provisions that weaken direct democracy and institutional independence. We must challenge this backsliding through lawful avenues, including petitions, civil society campaigns, and advocacy for a national referendum, ensuring amendments align with the popular will rather than elite agendas. The @cdfzim unequivocally rejects the bill in its entirety to uphold constitutional integrity, protect rights, and honor the sacrifices of past struggles. Collective action is imperative to reclaim and strengthen Zimbabwe’s democratic future.

I was assigned to serve as the Secretary General for @cdfzim’s diaspora working committee, I look forward to working together with fellow Zimbabweans in the diaspora in defense of the Constitution & advancement of constitutionalism, democracy & rule of law. In 2013, we the people voted YES to the Constitution, & today we the people say NO to any attempt to amend it. If that has to happen we the people should approve it. We might just be witnessing the start of WW3 before our very eyes on our screens The US and Israel are at war with Iran, this conflict has just destabilized the whole Middle East An already volatile region, with instability in many of the countries e.g Syria, Iraq, Yemen. And now Iran in retaliation has bombed countries with American bases e.g Qatar, Saudi Arabia, Jordan Whilst in Eastern Europe there's a war that's been raging on for years now, the Russian Ukraine War. And with neither party looking exhausted, it seems the war still has more years On top of it, in North America, Mexico to be exact, the country may even be on the brink of a civil war, with the CJNG cartel against the government in retaliation for the unaliving of their leader El Mencho Further down south, in Latin America, Cuba is obviously trigger ready at this point after watching it's close ally Venezuela, have their president Maduro kidnapped by the US special forces Then there's the issue of China and Taiwan, at some point, these 2 are going to get at it. China wants Taiwan, with the US occupied in the Middle East, maybe they'll see it as the perfect opportunity to strike All these global conflicts with the involvement of the super powers will have ripple effects on the rest of the world, leading to more unrest in other regions What's your take on the whole situation, can WW3 be avoided?

Mkoma you ought not to have tagged me because my response can only be unkind. You are clearly wrong as this very issue has been resolved by the CC. Thus, whilst it is clear on a textual reading that what you propound is legal heresy, you probably ought to have reasoned from the conclusion to the premise. Your conclusion, which means that ED’s term can be extended by 100 years sans consequence can only be so unreasonable that we must all say it is not bona fide reached. In other words, it is so outrageous in its defiance of logic so much so that we can only say it has been corruptly retained.

@matigary @Jamwanda2 @gift_mugano @ProfJNMoyo @adv_fulcrum @advocatemahere @ProfMadhuku @tino_chinyoka1 Sections 91, 95, and 328 of the Zimbabwe Constitution do not require a referendum to introduce a 7 year Presidential term and do not prohibit a sitting President from benefiting from the 7 year term!!! Law is still my passion. But I have not practiced it in a long time. So, rather than make submissions on the whole Constitution, I will limit my submissions to Sections 91, 95 and 328. Much has been written about Section 91. It deals with the number of terms and not the duration of a single term. My concern is the duration of a single term. Therefore I will not say more about Section 91. Section 95 appears to acknowledge that there is or could be another provision elsewhere that sets out Presidential terms. The 5 year term limit seems to only apply in the absence of another provision to the contrary elsewhere in the Constitution. It (Section 95) says in subsection 2: “2) The term of office of the President or a Vice‑President extends until— (a) he or she resigns or is removed from office; or (b) following an election, he or she is declared to be re‑elected or a new President is declared to be elected; And, except as otherwise provided in this Constitution, their terms of office are five years and coterminous with the life of Parliament.” If this is correct, there is nothing to stop Zanu PF through Parliament, and without referendum, from introducing a new constitutional provision providing for Presidential term limits other than the 5 year Limit. Put differently, there is nothing to stop Parliament, with the necessary majority, from introducing a clause that says, “A Presidential term shall be 7, 8, or 10 years”. Such a provision would not amend Section 95 (assuming it is the only section that provides for a Presidential term limit of 5 years). Such an insertion would apply to the sitting President without falling foul of Section 328(7) because the insertion will not be “an amendment to a term limit provision “. It will simply be an insertion to fill a gape or lacuna in the constitution. It appears the drafters of the constitution did not themselves know the duration of the term of office they wanted. If they wanted a five year term, it must have been very easy to just say that, “The duration of a Presidential term shall be 5 years”rather than frame Section 95 the way they did. I am not advocating for an amendment of the constitution. I am merely pointing out that there appears to be nothing stopping Zanu PF through Parliament from inserting a 7 year Presidential term provision in the Constitution without amending or contradicting section 95, and that there is nothing to Stop President Mnangagwa from benefiting from such an insertion.
