IG Metall Challenges Works Council Election Result at Giga Berlin in Court The IG Metall union has challenged the works council election at Tesla's Grünheide plant. As the union announced on Wednesday, a corresponding application under the Works Constitution Act has been filed with the court. IG Metall cites, in its view, impermissible election interference as grounds for its challenge. It claims there were indications of threats, intimidation attempts, and unequal treatment of candidates and lists. Employees complained that supervisors had exerted pressure in the run-up to the election the IGM stated. Many therefore did not perceive the vote as free. IG Metall cites several examples, including inconsistent treatment of campaign materials and statements made by managers to employees. In response to a media inquiry, Tesla stated that it "learned of the union's challenge to the works council election from the press." Tesla further stated that it acknowledges "that IG Metall, contrary to its claims made just a few days ago, has apparently withdrawn its support for the election, which it said was intended to 'morally clarify' the reasons for the clear failure to achieve its election goal." The proceedings will now follow the proper course of the law. "We have not yet received the relevant documents." The accusations made by IG Metall are factually unfounded and based on subjective assessments of employees interviewed by IG Metall or its allies. Employees are entitled to express opinions and emotions before an election; however, this applies to all elections and should in no way be confused with intimidation. That managers have an opinion on how employees should vote falls under freedom of expression and is not confidential – especially relevant when the future expansion of the plant is at stake. Therefore, I consider it unlikely that the court will uphold the lawsuit. Before every works council election in every German company, the workforce discusses who will vote for whom and why, and this is a perfectly normal democratic process. Knowing that if IG Metall gains a majority on the works council, the plant will not be expanded is a business decision and, while it may be perceived as intimidation by some employees, it is within the discretion of management to ake such an assessment and cannot and should never be restricted by a court. The union is also calling for stricter legal regulations for works council elections. In their view, a clearer obligation of neutrality for employers should be introduced. The IG Metall demand means nothing less that they want that no employer, no company and no manager may speak out against a union majority in the works council, and such a rule violates basic freedom of opinion and expression and should never be allowed. If the court were to uphold IG Metall's lawsuit, it would mean that the union could continue to sue for a repeat works council election until the result satisfies them, and this is not what the law protecting works council elections is about. I'm not a lawyer and may be wrong but I can't imagine that the court approves the demands from the IGM union. Es sieht wohl so aus, als ob FSD immer noch kurz vor dem Aufprall sich einfach abschaltet und dann wird der Unfall nicht mehr in die FSD Statistik genommen. Mich würde interessieren, was hier das Problem war. Reaktionszeit? Zu wenig Abstand? Hat die KI nicht Bremskraft vom Vordermann unterschätzt....
