I don’t have a transcript yet but she basically asked:
“Didn’t they put birthright citizenship in the constitution in order to avoid this type of debate over who gets to claim a domicile?”
And Sauer just stuttered.
And then Sonia Sotomayor comes in with the “doesn’t this open the door to the government withdrawing citizenship from people who were born here?”
More stuttering.

Yesterday, Governor Bob Ferguson signed Washington state’s first income tax into law.
Voters rejected an income tax as recently as 2010. In 2024 they went further — passing Initiative 2111, which explicitly banned the state from enacting one.
Democrats amended that ban and passed it anyway. 51-46 in the House. 27-22 in the Senate.
Senate Bill 6346 imposes a 9.9% tax on household income above $1 million.
The bill includes a “necessity clause” that blocks a public referendum. Opponents cannot put repeal to a vote.
The Washington State Supreme Court ruled in 1933 that income is property and must be taxed uniformly. That precedent has stood for 93 years. Democrats didn’t pursue a constitutional amendment. Instead they redefined the tax as a levy on the “receipt” of income — not income itself — and are relying on a current court to accept the distinction.
A lawsuit was filed the same day Ferguson signed it.
Washington was already ranked 45th in state tax competitiveness. New Jersey introduced its income tax in 1976 with a 2.5% top rate. It is now 10.75%.
Two years ago voters banned the income tax. Democrats wrote an exception into that ban, shielded it from referendum, and signed it anyway.

President Trump just left the scene at the Supreme Court.
Today wasn’t just a legal argument; it was a masterclass in why the "activist"
label—so often hurled at the Right—actually fits the liberal wing of the bench like a glove.
One one side, Solicitor General John Sauer stood his ground defending the administration’s move to bring sanity to our citizenship laws.
Justice Keyanji pounced.
He didn’t just face legal
questions. He faced a relentless buzzsaw
of "what-ifs" and hypothetical hysteria from Justice Ketanji Brown Jackson. It felt more like watching a political witch hunt interrogation than a judicial inquiry.
The core of the heated debate?
Does the 14th Amendment’s "subject to the jurisdiction thereof" clause really mean a "universal invitation" to the world, or was it intended for those with a permanent allegiance to the United States?
Sauer argued the latter, pointing out the absurdity of a system where a "plane ride" can confer the most sacred right of American life.
But Justice Jackson nipped that thought in the bud. She wasn't interested in the historical intent of the post-Civil War era.
She had plan. She pivoted straight to the shame and “how” strategy:
"Are we bringing pregnant women in for depositions to figure this out?" Jackson asked, leaning into a narrative of "government overreach" that the Left usually loves—until it involves securing the border.

Trump is addressing the nation tonight because his hand is being forced. Americans don’t know why we’re in this war and they certainly don’t like it. The latest numbers are rough: approval is in the 30s, he’s underwater with men and seniors, and barely holding on with white voters without a college degree. On top of that, 65% say his policies are making their finances worse. That’s not something that can hold for long.
