Some of y’all need to reevaluate your “New Year’s resolutions.” Scalley is one of the most cerebral individuals to ever walk on the hill. You think he didn’t see the offensive staff going to Michigan the moment Whitt was announced? You think he was hitting the high limit room in Vegas all week? Cmon folks. Please think things through a little more than that before looking silly on NYD. Trust the process, appreciate the 20+ year legacy Whitt built that has paved the way for Scalley to one day become the greatest Utah Man to ever walk on the hill. #FAMILY #UBOYZ

@UtahPigBus Great points but if a contract fails in business, is it the lawyers fault or the business owner’s fault at the end of the day? Not claiming to understand the details here but I think the question is fair…especially when $13mil is involved

ADs don't write agreements. Presidents don't write agreements. They don't negotiate the contracts and put in those terms. Lawyers and attorneys do. It's possible that our lawyers/attorneys may not have explicitly or implicitly added a clause that if he were to take another job outside the State, which he could do, he cannot hire any coaches or staff, or offer any current athlete with an NIL with Utah. And if he did, it could materially damage Utah and impact a "smooth transition", potentially affecting payment. In addition, any such violation could expose him to additional damages, depending on enforceability. If those protections were not included or were not enforceable, then it was the lawyers who failed. Legal is responsible for structuring protections around the decision to move on from Kyle, it's their job to offer legal protection in any employee separation. Either those protections weren’t included, weren’t enforceable, or it was believed the existing language would be enough to give Kyle's legal team pause or discourage poaching. The caveat is that if those provisions were in fact there, with strong wording and real teeth, and Kyle did it anyway and effectively dared Utah to get down and dirty, that’s a different story And Utah playing him anyway is a super-high road to take to avoid a terrible disruptive thing for Utah Football and Morgan to deal with. I am sure there is a FOIA request for Kyle's separation agreement from Utah, all the Twitter lawyers like me can give an opinion. Go Utes!

How do you offer a separation agreement with NO clause concerning immediately looking for outside employment or maybe more importantly, tampering with current Utah staff?! Seems like negotiations 101 but I’m not the “AD of the Year” so I’m sure there’s a perfectly good explanation 🤦🏽‍♂️

@801sportsfan So you give that much $$ for free? I’m cool with not saying he can’t find another job but not having any language around “tampering” with current Utah staff seems like basic business practice

@DTUI67 Why would Whitt sign that? He wouldn’t have to sign it. You can’t tell a coach he can’t find another employment.

@patrickbetdavid My dad was just trying to figure it out the best way he could based on what he knew. He might not have always done the best but he always had/has the best intentions. I’m grateful to have learned that lesson. I’m grateful for my dad.
