Rajasthan High Court held that allowing a wife to continue criminal proceedings against her former husband and in-laws after accepting ₹20 lakh as permanent alimony and obtaining a divorce decree based on a compromise would amount to an abuse of the process of law. The case arose from an FIR registered under Sections 498A and 406 IPC and Section 4 of the Dowry Prohibition Act, wherein the wife alleged cruelty, dowry harassment, and misappropriation of dowry articles by her husband and his family members. During the pendency of the criminal trial, divorce proceedings were initiated, and the parties ultimately entered into a settlement before the Rajasthan High Court. Under the compromise, wife agreed to accept a lump-sum amount of ₹20 lakh as permanent alimony. The amount was paid through a demand draft, her appeal challenging the divorce decree was dismissed, and the marriage stood dissolved through a decree of divorce dated 17 February 2025. Despite receiving the agreed settlement and securing the divorce, the wife did not withdraw the criminal case and continued to pursue the prosecution. High Court noted that the marriage had already been dissolved, the settlement amount had been accepted, and yet the criminal trial had remained stagnant for years because the complainant repeatedly failed to appear for recording of evidence. Court observed that this was a “reverse trend” where a spouse, after obtaining both divorce and monetary settlement, still sought to continue criminal prosecution against the former husband and his family members. Rejecting the contention that criminal proceedings were entirely independent of the divorce settlement, the Court held that the wife could not be permitted to “go back upon her proclaimed stand and take a somersault” after deriving the full benefits of the compromise.
