Eastern Cardano Council statement to the Cardano Community A new Cardano Constitution has now been enacted on-chain. Our vote on the Governance Action that presented it to the Cardano Community: gov_action1jxne7hynfd7frcczwumd2eggps4kvy0msjztz9t0mutpy870ksgqqp6vps addressed how the Constitution was produced, not what has now been enacted. With the new Constitution now in force, we will take the time needed to carefully review and understand its implications before considering further governance actions. During this period, we will not vote on constitutional matters on behalf of the community. This pause is intentional and responsible. It ensures that any future decisions are made with clarity, accuracy, and respect for the Constitution as it now stands. The constitution is extremely explicit, it says verbatim that the NCL must be agreed upon with a threshold of greater than 50% of active voting stake. There is absolutely zero mention of the words CC in relation to the NCL. Any attempt to consider it invalid is an explicit overreach of your authority, and a direct attempt to imbue the CC with authority that it isn't explicitly granted. Info actions cannot be considered unconstitutional because info actions cannot be enacted onchain. As per the constitution the role and scope of the CC is: > A CC shall be established as the branch of Cardano's on-chain governance process that ensures governance actions to be enacted on-chain are consistent with this Constitution. This scope, by definition, does not include any authority over info actions, because info actions do not get enacted on-chain. > Net Change Limit for the Cardano Treasury's balance per period of time must be agreed by the DReps via an on-chain governance action with a threshold of greater than 50% of the active voting stake The new constitution does not introduce any requirement for CC members to vote on the constitutionality of Info actions. Instead, it clearly that's that the CC is "limited to" voting on the constitutionality of governance actions. The wording is precise, it exists to limit the authority of the CC to vote solely with respect to constitutionality of proposals and no other bias, it does not state or indicate any requirement that the CC must vote on Info actions.

Net Change Limit Status The ECC team recently discussed the status of Cardano's Net Change Limit (NCL) and have determined that there is currently NO active NCL. This means that we will be required to find the treasury withdrawal governance actions currently on-chain as unconstitutional. The previously active NCL (gov_action169kllwhfmp488je5x5rwvufd08p8sztdcf0ghf5sp6ey2gnjdwaqql47xry) ended at the conclusion of epoch 612. While 2 governance actions were recently submitted to establish a new NCL, neither have met the criteria necessary to be considered ratified. While the Info action titled "Net Change Limit (Epoch 613 to Epoch 713)" (gov_action1m3xx08yv788vfxqh6nfvrjtvmqpwezsy0ggaczctkyjmttc2wmxsq4jsr7q) did meet the 50% DRep approval requirement, it did NOT meet the constitutionality assessment threshold by the Constitutional Committee. The latest NCL governance action titled "Net Change Limit of 300 Million ADA for Epochs 613–713" (gov_action1wwjwkg2g0qwr0mehey9r8gwn6qz3r28wl6wdl2s75kfmpy8j87tqqtft9tp) did NOT meet the 50% DRep approval requirement.

Our interpretation of the new constitution is different to this. While what you say was the case in the previous constitution, the new one introduced a requirement for the CC to vote on the constitutionality of Info governance actions. It didn’t exclude NCLs as an Info governance, so we believe therefore that NCLs are included in that requirement.

@EasternCardano @phil_uplc It might go something along the lines that you are ignoring the fact that the constitution explicitly requires only >50% active DRep stake for NCL ratification, not mandatory Constitutional Committee approval on info actions..

@mikerogero We will always abide by the decision of the CC, even if it is different to how we voted as one of seven. If this had sufficient “constitutional” votes to meet the required threshold, then we would consider it a valid NCL.

@EasternCardano Your argument is that it didnt pass CC threshold because there aren’t enough votes prior to your vote, or because you don’t believe the proposal is constitutional on its merits? Holders of a deciding vote, can’t a-priori say it didnt pass with enough votes. The logic is inverted

I have a plan. Submit a TWA for 1 ada. Copy and paste the previously approved NCL of 350 million ADA. Why a TWA? The TWA becomes valid at an epoch boundary, where an info action must run for 6 epoch. If we submit it now and rally the entire ecosystem, we can get it approved within an epoch. I am happy to submit it, but I do not have the ADA for deposit. If someone else woukd submit, or if I had donors (I woukd return your ada after), I would happily submit this. The constitution only requires the NCL be a governance action, not an info action. A treasury withdrawal is a governance action, and thus the fastest way to approve a new NCL since a treasury withdrawal becomes valid as soon as it hits the threshold.
