We have filed, on behalf of our Palestinian client, a demand for warrants for the leadership of Hamas at the @IntlCrimCourt for the crimes committed by the terrorist government of Gaza against the Palestinian people. @KarimKhanQC and the Office of the Prosecutor cannot say that they truly care about justice if they continue to ignore the blatant crimes committed against the Palestinian people by Hamas. These crimes include numerous crimes against humanity and war crimes committed by Hamas against the Palestinian people. Notably including the war crime of utilizing the presence of civilians or other protected persons as human shields. There has never been a demonstration that the Palestinian's are willing and able to investigate Hamas for these crimes. Hamas' purposeful conduct in Gaza has greatly exacerbated the harm against Palestinian civilians. The unnecessary suffering of the Palestinian people must be accounted for and the ICC cannot claim to care about justice if it remains silent on these crimes. Thankful to the work of my colleagues, Eli Rosenbaum, and @sarah_scialom, and our brave client who came forward to tell their story.
The Jerusalem Post@Jerusalem_Post

Exclusive: A Gazan man's lawyers made a submission to the International Criminal Court (ICC) prosecutor demanding that 14 Hamas leaders be investigated for crimes committed against the Palestinian people, marking the first such filing by a Palestinian against Hamas. ✍️ @MathildaHeller jpost.com/middle-east/ar…

Here's a fun fact: This is not why it was blocked. It was blocked because there's a provision in there permanently renaming the Department of Defense to Department of War. It also contains funding for the war in Iran that many Democrats have opposed. But, you know, facts and what not.
Josh Ruebner@joshruebner

BREAKING: Senate Dems, under the leadership of Sen. @ChrisVanHollen & @SenSanders, unite to block the NDAA from moving forward because of its provisions to deepen US-Israeli military and intel relations. This is remarkable and further evidence the US is moving away from Israel.

$1.15 trillion defense authorization bill blocked in the Senate. “It’s a war-funding authorization bill. This is an authorization for the Iran war, a war that nobody in this country wants,” - Sen Chris Murphy “It’s unprecedented not to pass the motion to proceed on the NDAA and it reflects a decision and a mindset on the part of Sen. Schumer not to cooperate at all because so much of this has been done on a bipartisan basis,” - Sen Roger Wicker thehill.com/policy/defense…

I've said this before, but it is absolutely insane that Drop Site has not been subpoenaed by Congress. This is an explicitly pro-terrorist outlet with direct ties to terrorists. A lot of people are being introduced to how insane Drop Site and Jeremy Scahill are today. Scahill outlines here that Oct. 7 was justified but all of Israel's subsequent actions were "genocide." He also believes Israel has zero right to missile defense and that Israeli civilians are being murdered by Israel, not by Hamas or terrorists. Since Israel has mandatory conscription, the leftist argument is that Oct. 7 was justified because all Israelis are military members. As I've stated before, ending aid is only the opening request. Leftists will demand a full embargo with Israel being unable to even purchase even defensive weapons. If you concede Gaza is a "genocide" then why would the US sell weapons to continue that? The whole point of branding Gaza a "genocide" was to lay the foundation to implement a total isolation of Israel. Scahill and the rest of the leftists want terrorists to be totally empowered against Israel to strike its population centers and want Israel to be incapable of responding. Of course, this is part of their broader assault against Western civlization as a whole, in which they believe the "global south" are the true moral protagonists and the rest of us are evil imperialists and settlers that should be forced to dissolve our societies and bow down or be murdered.

It requires having an honest understanding of what genocide is, and not what you want it to be. Genocide requires the act with the intent to destroy, in whole or in part, a national, ethnical, racial, or religious group, as such. Palestinians are absolutely protected. However, the intent here has never been substantiated or proven. In fact, every accusation has shifted the requirement. That and "in part" requires such a substantial number relative to the whole to threaten the existence of the group. The Gazan population pre-war was 2,230,000. The death toll is 73,000. That's 3.27%. That's not so substantial to threaten the existence of Palestinians in Gaza. It's quite literally impossible to prove that it's genocide unless you change what genocide itself is. If you have to do that to confirm a preordained conclusion, the problem isn't the law, it's you.

Genocide requires such a substantial destruction of the population that it threatens its very existence. See: ICTY's Krstić Appeal Chamber. The population that @RoKhanna is talking about has increased throughout the war in Gaza, and not factoring that into the analysis, has fallen by 3.27% over three years of war. Does that mean that Palestinians aren't suffering? Not at all, they absolutely are suffering. What they've gone through over the last three years is not something anyone should have to live through. Because it's not genocide does not make it good. Ro knows this. He's been shown the law and why what he's doing has caused Jews to be murdered here in America. He doesn't care.

I could have posted the easy video today. Ro Khanna’s story fell apart. My side is celebrating. The algorithm would have loved it. But the same week, radical settlers attacked a CNN crew with rods and a knife. And in March of this year, rioters spent six hours burning villages while the Iron Dome soldiers were defending Tel Aviv from Iran. I fight lies about Israel every single day. That job comes with one rule: I don’t get to tell you any. Israel doesn’t need protection from the truth, but from the lies. That’s not disloyalty. That’s being a Zionist.

And yet, the ICC has recently violated that very principle of complementarity. Why would that be?
Claudio Francavilla@ClaFrancavilla

Note: the #ICC prosecutes ONLY war crimes, crimes against humanity and genocide, and ONLY WHEN the countries concerned are unwilling or unable to. States committed to prosecuting their own nationals who may commit those very atrocities should have nothing to fear. Do the maths.

Hey, @AgnesCallamard, I'm still trying to understand why your report from @amnesty accusing Israel of genocide explicitly states that the jurisprudence of the ICJ would preclude a finding of genocide and how you make the determination that it's genocide if the law say it isn't? Here's the relevant passage of your report: "However, its rulings on inferring intent can be read extremely narrowly, in a manner that would potentially preclude a state from having genocidal intent alongside one or more additional motives or goals in relation to the conduct of its military operations."
Agnes Callamard@AgnesCallamard

🚨🇪🇺🇮🇱 Failure to suspend EU-Israel Association Agreement must spur member states to take unilateral action: It’s beyond shameful that a majority of #EU member states, led by #Germany  and #Italy, continue to block the suspension of the EU-Israel Association Agreement. Countries committed to uphold international law must not remain silent while others actively undermine the very principles they claim to defend. As the current holder of the Presidency of the @EUCouncil, Ireland is in a powerful position to influence the EU’s course of action on #Israel. It must seize this critical opportunity to help ensure that member states meet their obligations under international law. Ireland’s experience of colonization, famine and conflict, its leading role in international efforts to end apartheid in South Africa and its recent albeit limited progress towards banning imports of goods from settlements, give it a unique perspective and authority that should be used to seek accountability for Israel’s grave violations and to anchor EU policy on the Occupied Palestinian Territory firmly in the protection of human rights. If the EU will not act together, member states must act individually and unilaterally suspend all forms of cooperation with Israel that may contribute to its grave violations of international law, including by imposing a comprehensive embargo on the export of arms and surveillance equipment and related technology, and a total ban on trade with and investment in Israel’s illegal settlements in the OPT. The EU must stop allowing Israel to face no meaningful consequences for its ongoing genocide against Palestinians in Gaza, its system of apartheid against Palestinians, including its ethnic cleansing campaign in the occupied West Bank, its unlawful occupation of the Palestinian territory, and war crimes in Lebanon. In the pages of history, there will be a clear distinction between those who failed to act in the face of Israel’s genocide against Palestinians in Gaza and those who stood up for humanity

A reminder: @RoKhanna knows that these legal determinations cannot be sustained. One can oppose the actions of the Israeli government without delving into complex legal determinations that have required to shift the legal standards to fit the predetermined conclusions of every single accuser of them. Seriously, every single accusation has required shifting the jurisprudence. See, @amnesty who said that the jurisprudence of the ICJ would preclude a finding of genocide: "However, its (ICJ) rulings on inferring intent can be read extremely narrowly, in a manner that would potentially preclude a state from having genocidal intent alongside one or more additional motives or goals in relation to the conduct of its military operations."
Marco Foster@MarcoFoster_

Ro Khanna: “They’re just lying. I guess the people who lied about the genocide are going to lie about the detainment of Americans. Israel needs to be treated like an occupying power that is engaged in apartheid in the West Bank and has committed a genocide. Those are just the facts on the ground”

I’m honored to be labeled a “hostile entity” (#2 in fact) by the terrorist Islamic regime’s Ministry of Intelligence. The regime has published this list to threaten the Iranian people and prevent them from speaking to me (and a lengthy list of other prohibited activities) under the possible penalty of 2 to 15 years in prison with the possibly of the death penalty if the “crime” is severe enough. Imagine being so pathetic that you threaten to kill people for speaking to Israelis. They are terrified and it’s pathetic. The best part of all, however, is that the Iranian people are smarter than these regime scumbags and will continue to resist until the mullahs are all in the grave. Payandeh Iran! ✌️
