🛑 Last night, the Deltona City Commission voted 4–3 to move forward with Ordinance No. 29-2025, a proposed development moratorium that directly defies state law and, in my view, violates the oath of office we each swore to uphold. Let me be clear: I will not sign any documentation that knowingly violates Florida law. Doing so would not only be malfeasance, it would also put our City at serious legal risk. 📜 Senate Bill 180, signed into law by @GovRonDeSantis on June 26, 2025, clearly prohibits local governments within 100 miles of a hurricane track or those impacted by Hurricanes Debby, Helene, or Milton from enacting new development moratoriums for a period of up to 3 years, retroactive to August 1, 2024. Here’s what I shared with our legal team, city manager, and city clerk: ✅ I will not sign Ordinance No. 29-2025 ✅ I will not violate my oath or invite legal jeopardy for our City ✅ I recommend the Commission designate another official, should they choose to proceed ✅ I urge reconsideration, in full recognition of State preemption 📨 I also respectfully call on @AGJamesUthmeier / @JamesUthmeierFL to review this action and evaluate whether malfeasance or dereliction of duty has occurred by those who knowingly pushed a preempted ordinance. The @CityofDeltonaFL deserves leadership rooted in lawful governance, fiscal responsibility, and infrastructure-first solutions—not political theater that places us in legal jeopardy. I stand firmly in defense of the rule of law and the people of Deltona.
