Okay so now you are going to start tossing out Amendments because you don't like them. The 14th Amendment is clear. All persons born....are citizens of the United States. "Subject to the jurisdiction thereof" in the 14th Amendment means being born within the U.S. and under its legal authority, rather than owing allegiance to a foreign power. Individuals in the U.S. without legal authorization are under the jurisdiction of the United States. They are subject to U.S. laws, can be arrested, taxed, and regulated by federal and state governments. Furthermore, they possess fundamental constitutional rights, such as due process, while within U.S. territory. End of story.
