There are many gaps in claims that DAOs are partnerships. For example a threshold issue to finding that a partnership exists is the contribution by a partner of partnership property *into* the partnership. There is no buyer or seller. Gap 1: when you buy a token on an CEX there is no contribution into a partnership , there is a buyer taking the other side of a trade from a seller; there are no partners exercising control over your “property contribution” to a partnership. Gap 2: the ability of a token to vote on-chain does not contribute property to a partnership; the token never leaves custody and no one else can make of use the token for any purpose. Uh oh !
