In a compelling case recently argued by our Family Law Department—Milimani High Court MISC/E168/2024—the Court confronted a rarely-litigated but deeply personal question: Who has the right to name a child?
The facts were simple yet significant. A mother, acting alone, gave their child a name—entirely excluding the father from the process. Feeling sidelined and seeking legal redress, the father brought the matter before the High Court.
The Court, in a thoughtful and progressive ruling, emphasized the sanctity of joint parental responsibility and held:
🧾 “The issue of names and naming is a right generally bestowed upon the parents... [It] cannot be derogated or transferred to any third party unless otherwise shown.”
🧾 “The 1st Respondent, though the biological mother, cannot unilaterally take the initiative of naming the minor without the consent of the father.”
This ruling affirms what many have long felt—that names are more than just labels. They are identity, heritage, and connection. Courts are now recognizing that naming a child should be a collaborative act—not a contested battlefield.
