At the age of 88, Morarji Desai had to travel to Chicago to personally pursue the case and testify in the Court.
He was asked some hard hitting and embarrassing stuff - eg as the PM of India, did he allow or not a secret CIA op assisted by RAW to plant a nuclear powered American surveillance station on Himalayan peaks in Indian territory to monitor China and USSR?
Kissinger was subpoenaed to appear before the court. First he stated that he did not believe Desai to be the asset CIA had in Indian government. In cross questioning by Hersh’s lawyers, Kissinger was forced to agree it was possible that Desai was that asset.
Kanti Desai roared that the would appeal in the US Supreme Court. But probably on advise of his lawyers, they accepted the verdict.
Coincidently, in less than a year, Pakistan awarded Morarji its highest civilian award Nishan e Pakistan. Before he got Bharat Ratna the following year.
Sometime before this, Kanti Desai (Morarji was living then with him) had lost another very visible legal case in Bombay. Desais had been occupying a prime apartment in Bombay since 1956 - a huge 3500 sft sea facing property - owned by an elderly couple who did not even want to rent out the apartment to them in the first place, but forced to by a British era law to give it on rent if Government demanded so. Morarji was Bombay CM when Kanti Desai got it in his name against the wishes of the owner who wanted to live there themselves. Bombay Court after 2 decades finally asked Desais to get out of there - the order itself was very curt.

Morarji Desai filed a libel case in a US Federal Court against Hersh M Seymour, the Pulitzer winning investigative journalist and author of this book. Desai demanded an apology, withdrawal of portions, and $100 million penalty. Seymour refused - and said 6 highly placed US Intelligence officers have informed what he wrote. Case went to trial. Kissinger himself was subpoenaed to testify before the court. After arguments, Jury for two days deliberated and decided against Morarji Desai. Kanti Desai, Morarji’s son wanted to take the case to the US Supreme Court but didn’t. What Seymour wrote about Desai stays in the book. Not sure if the book was/is banned in India.
