🚨 The federal judge’s order dismissing Andrew and Tristan Tate’s $50 million lawsuit against Meta is absolutely scathing.
Some of the most brutal passages:
The judge says the Tates’ complaint quoted sections of Meta’s terms of service that apparently did not even exist in the documents they cited:
“the quoted language is not included in the Terms of Use attached as Exhibit A to the Complaint as represented.”
And during oral argument, the judge says the Tates’ lawyers could not explain where the language came from:
“Plaintiffs were unable to identify how that error was included in the Complaint or where the quoted language came from.”
It gets worse.
The judge describes:
“many minutes of silence while Plaintiffs' counsel scrolled through all the potentially relevant documents on his computer”
trying to find support for their claims during oral argument.
The court ultimately concluded:
“Plaintiffs have no good faith basis for this assertion.”
The judge also dismantled the Tates’ First Amendment arguments, stating plainly:
“Meta is a private actor and thus its conduct constitutes private abridgement of speech to which the First Amendment does not apply.”
And regarding allegations of government coordination:
“Plaintiffs conceded their vague allegations were insufficient to allege Meta acted in concert with a government actor.”
The order repeatedly states the lawsuit is barred by Section 230 of the Communications Decency Act, with the court writing:
“Meta’s conduct can be boiled down to deciding whether to exclude material that third parties seek to post online, and is therefore immune from liability under section 230.”
Perhaps most damagingly, the judge cites Rule 11 standards regarding frivolous filings and factual support, writing:
“Plaintiffs’ oral argument statements reveal neither they nor their counsel have a factual basis”
for major allegations in the lawsuit.
The case was dismissed without leave to amend, meaning the court concluded amendment would be futile.
This is not just a loss for the Tates - it is one of the most brutal judicial rejections you will ever see in a high-profile influencer lawsuit.
