Here is my situation,
My daughter went missing (29 y/o) on July 9th, 2023.
She is/was a mother of a 2 y/o and a 8 y/o little girls.
When she went missing, I took my granddaughters in since the dad has never been in the picture.
After a few months, I had to clean out her rental house and bring her belongings to my home.
I fell behind on my mortage since I'm looking for my daughter, plus I am now raising a family again that I wasnt prepared to do over again.
I tried to negotiate a new loan modification with the bank, I signed the new contract, mailed it in, and the bank denied the loan modification.
They denied it stating that I have a lien against the property that I must take care of first.
The bank would only give me the instrument number of the lien, no other information.
I knew that there is no lien in my name or even on the property.
I went to the local, state, federal and land conveyance offices and they could not find any liens against me or on the property.
I contacted my title company and they couldn't find anything on me or on the property.
No one would print anything out to prove that there is no lien on me or the property except for the title company printing out a new title for me that showed no lien
I contacted the bank and told them exactly what I have done and emailed the bank what my title company had given me.
The bank tells me that they would review the information and that they will contact me back.
A few months later, I receive foreclosure papers in the mail.
I immediately called the bank and asked why.
They said that there is still a lien against me with the instrument number that they had given me.
Im now back going to the very same offices that I have been to before, same results as the last time, couldn't find any lien against me or on the property.
Since I live in Hawaii which is an Asian melting pot, I asked my title company to search again with that instrument number, but this time to search just using my first name, and dont use my last name, use my middle name as being my last name.
Hold and behold, my title company found that this lien belongs to a Timothy James Lee, with the exact same instrument number being attached to it.
My title company printed out a copy of it, showing that the lien belongs to a totally different person, a General Excise Tax lien.
I called the bank and emailed the bank the document that my title company had given me.
The bank says that they will review it and will get back to me.
This was back in December of 24.
January 11th, on a Sunday, this lawyer came to my home and says that my home has been foreclosed on and that he has 2 open houses to show the home for auction.
I told him that that isnt happening.
I get court papers 2 weeks later with a court date back in March.
I have been trying to reach the VA about that new VA Home Loan Reform Act.
This act is passed in July of 2025 to replace VASP.
I talked to someone from the VA eventually and was told not to worry, go to court, explain my situation, that the new Home Loan Reform Act hasn't been implemented yet due to training needed and that I won't lose my home.
I went to court back in February, and the Judge postponed court until April 14th.
The Judge gave me a name of a person that he knows well from the VA, along with her phone number to contact for help.
Have been trying to call her to no avail.
I went to the VA benefits office here in Gilo, Hawaii, trying to seek this person out myself.
The lady at the counter said that the lady that I am looking for hasn't worked for the VA for several months now.
The lady at the counter hands me a pamphlet with another name of a person, along with her cellphone number to call in Honolulu, HI, a whole different island than the one that I am on.
This is a very small office in Hilo, HI.
I have been calling that cellphone number to no avail.
It's a voicemail greeting telling you to call this number for medical and this number if your suicidal, or leave a brief message for
