ABSOLUTE DISCHARGE IN DANGEROUS DRIVING TRUCK DRIVER CASE TIED TO 2021 FATAL CRASH ON DAWSON ROAD LOCAL FAKE NEWS REFUSE TO TELL PUBLIC ABOUT DANGEROUS DRIVING FOREIGN TRUCKER A 33y/o AJITPAL SINGH (Sept2/92) appeared by video from Winnipeg on May 4/26 in the Superior Court of Justice in Thunder Bay to learn his sentence for a dangerous driving incident on Dec12/21 on Highway 102. Justice Stephen Wojciechowski heard SINGH plead guilty on Nov21/25. SINGH required a Punjabi interpreter for all proceedings and made an informed plea knowing there might be immigration consequences. SINGH is an Indian citizen in Canada on a work permit. AGREED STATEMENT OF FACTS Provincial Crown Attorney Sivandesh Koveerasingham told the court that at SINGH was travelling westbound in a tractor trailer at 12:50pm on Dec12/21. SINGH was following another tractor trailer which was being driven by MOHAMED AHMED, who in turn was following a red Ford SUV driven by James Young. As the three vehicles traveling together approached the Wildwood Variety store in the vicinity of Auto Road, the SUV began to slow down in order to turn left into the parking lot of Wildwood Variety. During the process of making his left hand turn, Mr. Young noted in his rear view mirror that Mr. Ahmed was not slowing down, and as such, he took evasive action and pulled right and forward off the highway in order to avoid being rear ended by Mr. AHMED. Mr. AHMED, upon noticing the passenger vehicle’s manoeuvre, braked heavily in an attempt to avoid the SUV, causing his tractor trailer to enter the eastbound lane of Highway 102. Driving eastward towards Wildwood Variety – and the vehicles being driven by Mr. AHMED and Mr. SINGH – was another tractor trailer driven by MICHEL PHARAND with MARIE-PAULE LANDRY as a passenger. AHMED applied his brakes suddenly, his tractor trailer jackknifed into the eastbound lane. At the same time, Mr. SINGH was following so closely that he did not have much time to react. While Mr. SINGH attempted to use his brakes as well, it was too late to prevent the front of his tractor trailer from colliding with the rear of Mr. AHMED’S vehicle. The resulting collision pushed Mr. AHMED’S vehicle further into the eastbound lane and a head on collision occurred with Mr. PHARAND’S vehicle. Upon examination at the scene, no brake or skid marks were found on the highway caused by Mr. SINGH’S vehicle. As a result of the collisions between Mr. PHARAND’S and Mr. AHMED’S tractor trailers, Mr. PHARAND was killed, and Ms. LANDRY was severely injured, fracturing her pelvis and causing extensive injuries to her knee and shoulder. Mr. SINGH did not suffer any personal injuries as a result of this accident. Having regard to all the circumstances, Mr. SINGH was operating his vehicle in a dangerous manner by following too closely to Mr. AHMED’S vehicle, limiting his ability to react to slowing vehicles on the highway. Mr. SINGH’S conduct exhibits a marked departure from the standard of care a reasonable person should exercise in similar circumstances. SENTENCING SUBMISSIONS Sentencing submissions occurred on Feb6/26. The court heard a victim impact statement from MARIE-PAULE LANDRY. She experienced anger and sadness with the loss of her partner, Mr. PHARAND including the loss of no longer being in each other’s company, sharing their thoughts, traveling together, and enjoying their lives with their children and grandchildren. Emotionally and financially, Mr. PHARAND’S death has been difficult for Ms. LANDRY noting that she will never be the same person she was before the accident which has had repercussions to her having a normal life. KARINE BÉDARD is the daughter of Marie-Paule Landry, who provided the background to her receiving the news of the accident, and being with her mother as she was treated for her extensive injuries and the subsequent period of rehabilitation. The loss of Mr. Pharand has had a major impact upon Ms. Bedard and her family, including her three young children. As well, Ms. Bedard detailed the heartbreak of watching her mother have to cope with chronic pain and limited mobility caused by the accident. Her heart is full of sadness, unable to find peace with the events which have left her mother struggling every day and which caused the permanent loss of her guardian angel and her children’s grandfather, Michel. Provincial Crown Attorney Sivandesh Koveerasingham had argued to His Honour that a conviction was necessary along with a $3,000 fine, and 2-year driving prohibition. Any chance of deportation was a collateral consequence of this crime. He further argued that to not enter a conviction was akin to a two tiered justice system. SINGH should receive a conviction. He willingly plead guilty knowing the possibility of deportation was there. SINGH’S conduct and driving behaviour warrants accountability and a sentence which reflects general deterrence. Defence Attorney Harval Bassi sought a discharge, citing “very real” immigration consequences. SINGH arrived in Canada in 2018 on a study permit and worked as a truck driver. He would face certain deportation as a foreign national under the Immigration and Refugee Protection Act. He’s also offering to pay $10 000 to the surviving victim, MARIE-PAULE LANDRY. SINGH has told the court he is sorry for his mistake and it won’t happen again. DECISION Justice Wojciechowski has ruled that deportation would be a disproportionate result to the crime and orders that an ABSOLUTE DISCHARGE be granted. An 8 year driving prohibition is also ordered, along with a $10,000 restitution order payable to Marie-Paule Landry. THE COURT HAS SHOWN THAT TWO TIER JUSTICE IS PRESENT IN CANADA. LOCAL FAKE NEWS IS AWARE OF THIS AND REFUSING TO INFORM PUBLIC AGAIN
