This is unfortunately an incorrect reading of the Balfour Declaration and the Palestine Mandate as awarded by the San Remo Conference. The Balfour Declaration did not promise the Jewish people a state, and nor did the San Remo Conference. The League of Nations Mandate adopted the words of the Balfour Declaration, and therefore cannot be taken as awarding exclusive statehood to the Jewish people in Palestine. Indeed, Churchill's White Paper of 1922 explicitly said there was no intention to make Palestine a Jewish state. The United Nations in 1947 did agree that the Jewish people should have their own state, but it did not authorise the creation of such a state from the whole of the territory of Mandatory Palestine. Israel today is quite a bit bigger than the state envisaged by the UN in 1947. Today's UN has repeatedly said Israel has no right to the West Bank or Gaza. It is wholly unreasonable of Lieberman to claim the authority of the UN for the creation of the Jewish state while repudiating it for the creation of the Palestinian state that the UN also approved in 1947.

A momentus decision by the ICJ that is likely to start the political dynamics to end Israel's genocidal war on Gaza: there should not be an Israeli exception to the prevention of genocide. Some initial thoughts:

Germany will intervene in #SouthAfrica v #Israel & presumably take positions aligned with Israel. Note that #Germany has also intervened in #TheGambia v #Myanmar. Hard to see how Germany can back away from the more expansive interpretation of genocidal intent that it urges there.

5 Key points of Israel's presentation: 1) Israel placed a lot of importance on procedural issues - specifically, that the ICJ has no jurisdiction because there is no dispute, as South Africa did not wait for Israel to fully engage with it. This was it's weakest argument imo

14/14 Evidence presented by Isr. failed to consider gravity and magnitude of suffering caused to date & systematically show that it was, and is, in its totality, necessary and proportionate. Also to address probs with self-defence arg. SA arg therefore stronger.

13/14 Key then, is whether ICJ sees the right to self-defence sufficient grounds to negate 'plausible risk of genocide' arg. Crt likely to cons. whether the attacks as launched by Isr prima facie necessary, proportionate, unintended to bring abt suffering in acc. with IHL.

4/14 Shaw: SA fails to show ICJ jurisdiction. In 'bizarre story' of Isr response to note verbale, SA evidences a 'one-sided clapping of hands'. The element of interchange and bilateral engagement not been made out. ICJ in Marshall Islands authority that I must be able to react.
