Perhaps it was his fault she got to that point, doesn’t really matter. Her decisions and actions preclude her from being safe with a child.

That's an odd take. I'm not going as far as some who suggest Mr. Aylaian deliberately coordinated a team of police buddies he hoped would shoot her, but he certainly devoted considerable effort in trying to have Ms. Fitzsimmons convicted and sent to prison for her son's entire childhood. Maybe you think she should have been nicer to him about that. Some observers have suggested that Mr. Aylaian himself began a "smear campaign" with absurd personal accusations and what many see as grotesquely inaccurate accusations in a contrived, almost "professional" abuse of the court system to obtain a false pretense restraining order. If you think Ms. Fitzsimmons should just sit there and take it, you might not have listened to the trial testimony carefully enough. "Sit there and take it" is a manifestation of the problem, not the solution.

It blows my mind that these assholes have decided Kelsey is the aggressor based on his say so, and the say so of those who have chosen to lie for him. Lies told by a group of drunk/drugged rowdy party goers! But Kelsey has proof he is the abuser and they dismiss it! Like seeing and hearing him saying nasty obnoxious things to her, about her, isn’t evidence of HIS pattern of verbal and emotional abuse. We know for a fact the hit & run claim was a lie! We know for a fact he is recorded lying to NAPD on the phone. We know for a fact he lied to her, repeatedly. We know for a fact Miss Mitchell lied to her on the phone, because a lie of omission is still a lie Michelle, you were straight up keeping tabs on Kelsey while you conspired with Justin against her, to get her 4 month old baby taken from her! Kate says abuse is a pattern of power and control. Isn’t that what she’s done to Aidan, his family and the women he’s been involved with. Hasn’t every single one of her relationships been abusive? Rick Kelly, Steve Young and Andrew Johnson have all abused her (according to her). Justin put drugs in Kelsey’s car. Justin abused drugs and it’s all on tape Justin called the shots June 29th and June 30th. Justin verbally abused her on tape Justin abused and threatened the police on tape. She felt helpless & suicidal because she was a new mom, verbally & emotionally abused by her partner (who is a fall down drunk), and his family who persuaded their party friends to lie for him, knowing she had postpartum depression, then sent her employer to her house to take her child. She wasn’t abusive, she was abused!

So you are saying Justin gets to verbally & emotionally abuse her, while she is dealing with postpartum depression, have his family and friends attack her at a bridal party, take out an RO with allegations he did not have to prove, and resulted in her coworkers coming to her house to take her child, but it’s her fault? She did not “prove his point”. He manipulated her friends, the courts, and her employer, with full knowledge that she was emotionally vulnerable and he used her friends and his family to help him do it. That is straight up cold blooded dude.

@LDTEmeritus But, her reaction obviously justified any concerns he had, over his child’s safety. If his allegation was that she wasn’t sufficiently mentally stable to care for her child, she certainly proved his point.

I invite anyone else who was there today to verify what I witnessed, because I’m being told it didn’t happen. I was there when officers cut the line before the courthouse doors even opened. I watched them bypass screening and take the front of the line at the courtroom. I was there when they all retired to a reserved room on the third floor to wait for the verdict. I was there when they started marching down the back stairs—before anyone else was even notified that a verdict was coming in. I was there today when the court officer stepped out and told everyone waiting in line for the verdict that position in line doesn’t matter. I was there when court officials announced: “Officers get first priority for seats after family and witnesses. The rest of you may not get a seat.” I was the very last citizen allowed into the courtroom—only after family, witnesses, and officers had been seated. Everyone behind me, who had waited was turned away. I was there for the victim too. That didn’t matter. By official announcement, officers received special treatment and were allowed in before me. Don’t tell me what I didn’t see and hear with my own eyes and ears. They were handed clear preferential treatment. Justice Served TV @JusticeServedTV and @IanRunkle both covered this issue tonight. Just because you have a badge doesn’t give you special status over every other person who wants to watch a trial. A badge doesn't guarantee you a front row seat. And anyone who thinks that the officers were there supporting the defendant, I have a bridge to sell you. Just because you have a badge doesn’t give you unlimited seating in the courtroom over the rest of the public.

Now that I have actually scene the video, ummm the guy has eyes and is not legally blind, so it is pretty obvious that he is aware he is being recorded. By Turtleboy metrics (see: his defense of the criminal complaint he took out on Meredith O'Neil) this is a crime of the highest order and must be filed and prosecuted. I look forward to the Turtle coverage insisting Kelsey Fitzsimmons be convicted of wiretapping.

If you read what the judge actually said, it's clear that he believed Noonan's testimony was truthful, but that the evidence wasn't there for a conviction. If a bodycam had been used, Kelsey would be enjoying breakfast in jail.
