I wrote an analysis about a year ago, now unfortunately lost, that I will now re-summarize about how the Supreme Court *might* rule in Trump's favor. The key case here is Wong Kim Ark. Many Leftists and academics will repeat that this case stands for the proposition that Trump is just plainly wrong, but I'd argue that this is because they weren't reading with enough attention to detail. Wong Kim Ark presented a deceptively narrow question that the Supreme Court sought to answer. The Court flat out says this was the question they were considering: Does the 14th Amendment grant citizenship to: (1) a child; (2) born in the United States; (3) to parents who are lawful permanent residents of the United States. There's a sort of Mandela Effect that caused a lot of people to think that the United States operates on a one-dimensional jus soli basis of citizenship, but that just isn't what the Court said in Wong Kim Arm. I assume this came about because the concept of an "illegal alien" didn't exist for most of the nation's history. You'll find a lot of hoop jumping to explain away Element #3, but its all smoke, mirrors, and spell casting. The Supreme Court has never ruled any other way. All of the extensions of birthright citizenship to non-lawful permanent residents have come from lower courts, law professors, Department of State policies, and to a limited extent Congress. If the Supreme Court ends up ruling in Trump's favor, I would bet that this is the ultimate basis for doing so.
