NEW: Updated EHRC code to be published in May @bphillipsonMP has made a statement saying that she intends to lay the updated draft of the @EHRC’s code of  practice before Parliament “as soon as practicable” after the local and devolved administration elections. Then after 40 days, if neither house passes a resolution disapproving the draft, it will come into force. The EHRC has admitted that it amended the guidance after the government provided it with “a narrow set of comments” on its previous draft. Neither the minister nor the independent regulator is mandated to engage in this sort of delay and negotiation whereby the independent regulator edits its guidance to meet the preferences of the government. Section 14(7) of the Equality Act 2006 says that before issuing a code the EHRC shall submit a draft to the Secretary of State, who shall either approve the draft and lay a copy before Parliament or give the EHRC written reasons why she does not approve it. The legal framework does not envisage this as a back-and-forth process of backroom negotiations between the government and the EHRC. It is concerning that in her statement the Minister for Women and Equalities continues to focus on specialist service providers such as hospitals and women’s refuges and has still not made clear that ALL employers and service providers that offer single-sex or separate-sex facilities do so under the Equality Act, which recognises that men who have the protected characteristic of gender reassignment remain men, and do not have the right to access facilities provided for women and girls. Delaying laying the guidance till after local council and devolved administration elections is more unjustified procrastination. The government has patted itself on the back, saying: “We are getting it right, showing leadership by implementing the clarity the Supreme Court ruling delivers.” Yet government departments up and down the country are still operating with unlawful policies that the previous head of the civil service refused to withdraw.

For gender-critical academics, participation in public debate has long carried professional and personal risks. But following the Supreme Court’s ruling in @ForWomenScot, are we seeing something more explicitly violent — and more systematic — start to emerge? A militant trans activist group known as Bash Back has issued a “direct action” guide urging members to identify “transphobic” targets, including MPs and “public intellectuals”, and ensure they are “hit repeatedly until they desist” from their activities. In an equipment section, the group lists items such as a hammer and advises activists to clean tools with alcohol or dispose of them after use in “unsurveilled residential bins”. This is not mere online fantasy. Bash Back has already claimed responsibility for attacks on the constituency office of the Health Secretary, Wes Streeting, and on the Free @SpeechUnion. It also vandalised the offices of the Equality and Human Rights Commission last year. At CAF, we regularly deal with cases involving gender-critical academics who are reluctant to take their concerns public for fear of professional reprisals. If direct threats of violence are now being added to an already hostile climate, reluctance to pursue teaching or research on the importance of biological sex begins to look like common sense. To check that chilling effect, universities need to respond robustly, particularly at the point where these pressures tend to crystallise: in the hosting of events, seminars and public lectures. Too often, instead of identifying the problem as threats, intimidation, or a potential heckler’s veto by trans activists, institutions treat it as inhering in the speech itself: the speaker is “divisive”, the topic is “high risk”, the event “creates tension”. Under the Higher Education (Freedom of Speech) Act, that gets the analysis the wrong way round. The compliant question is not, “Does this gender-critical event generate risk because a small minority of people think the views are harmful?” but, “Is there credible evidence of a specific threat, and if so, what practical steps can we take to ensure the event goes ahead safely?” Acting in any other way risks handing those willing to commit serious crimes exactly what they want: the power to curtail #academicfreedom.

Whatever the Supreme Court ruling says and the government guidelines do, transgender people should just use the bathroom they want to use and take every single situation to court with biological information. On that basis, it could be overturned because there was no information that transgender people exist in this Supreme Court case. it was not looked at. So they could be another ruling.
