If the matatus are ungovernable and inefficient. They should pioneer alternatives. After all, it's the government that started public transportation.

Recusing himself leaves the bench with six judges which is even number meaning they cannot have a majority. This would create a constitutional crisis incase the decision went 3-3. The main function of supreme court is presidential elections petition and if he cant do that, he has no business being in the supreme court bench
