Practitioners and Laymen: Q. Why do you think the rate of guilty pleas is so high in Federal Court? A. Because cases get to trial. A looming trial date tends to galvanize a defendant's thinking. Federal cases get to trial because they are nearly impossible to derail pretrial with motions that challenge the evidence. That's because of the grand jury system. Once the grand jury indicts, the system's default is "A Jury trial is necessary to determine not guilty/guilty beyond a reasonable doubt." There almost zero room in the process for judicial intervention that says "The Grand Jury should not have done that." There is no "mediation" or referral to arbitrators, or discovery to further develop the evidence, or summary judgment motions to end the case prior to trial. There is an indictment, a plea, or a trial. That's it.

Something reflected in the NYT story about the leaked memos that does not make sense in the modern era is the continued practice of Justices employing "Law Clerks" 2-3 years out of law school with no actual experience practicing law as their main source of staff help. In a bygone era that might have been an appropriate method of operation. In the modern era, with tens of thousands of highly intelligent and talented practicing attorneys with a decade or more of experience, who would sacrifice a year of their practice to spend that year working on the staff of a Supreme Court Justice, continuing to use 20-something quasi-students in that role makes no sense. There is no functional difference between that law clerk and a first year associate from an Ivy League law school at a big law firm that gets nothing of importance to handle without massive supervision. Kicking those kids around courtrooms is quite entertaining. This SCOTUS practice should end.

Assuming this is true, She cannot be trusted under any circumstances. She tried to get this man fired for saving her life. Her “trauma” doesn’t play into it at all.

Imagine saving a Lady's life at work… and getting reported to HR two days later for s*xual harassment. He’s a quiet guy but friendly with everyone at work. He normally treats his coworkers like friends. About two months ago, during a work lunch, one of his colleagues suddenly started choking on food. Everyone panicked. So he quickly stepped in and did the choking rescue method where you stand behind the person, wrap your arms around their stomach and press inward and upward to force the food out of their throat. After a few pushes, the food came out and she could breathe again. Everyone around them cheered. He simply asked if she was okay. She nodded and rushed to the bathroom without saying much, so he didn’t think anything of it. Two days later, HR called him in. They told him the same colleague had filed a complaint saying his touching during the rescue made her uncomfortable. She said his body was too close and that she felt his private area while he was helping her. He was shocked. They placed him under investigation for a week while he continued working. Eventually HR cleared him completely. But after that, he changed how he interacted with her. He kept distance, only spoke to her when necessary, and stopped including her in casual hangouts. She later apologized and explained she had past trauma. Still, he kept his distance. Now she says he’s being petty. He says he’s just protecting himself. Was he wrong for permanently stepping back even after her apology?

The heart of this problem is the Senate's "blue slip" tradition. It is a de facto mechanism by which POTUS nominees to positions requiring Senate confirmation can be blocked without a debate or vote on the nomination -- Senate "Advise and Consent -- ever being given. The Dems are using it to obstruct the Trump Admin from filling DOJ positions. The GOP are allowing them to do so because they want to preserve their option to do the same in the future. And the Court blames it on the Executive as a "power grab" when it is just the opposite. It is response to Senate Dems who won't allow allow an up or down vote.
