This was supposed to be about consultation. Now it’s being framed as shared authority, while people are told not to worry about their homes or businesses. @mrsabrabbit Nope. The Supreme Court has the power to interpret the Constitution. It can’t change the words of the written text, but it can dictate what the words mean, and “find” things in there that aren’t written down. In effect, we are ruled not by the Constitution but by the Court.

The invocation of the Emergencies Act unjustifiably violated the freedom of expression of Canadians, among other violations. Four judges from two levels of court have now stated this definitively. We hope that the Supreme Court of Canada comes to the same conclusion, but we have reason to be concerned about the impartiality of the highest court on this issue. As detailed by Professor Pardy in his National Post article in June 2022 (linked below), Chief Justice Wagner commented in Le Devoir earlier that year, condemning the Trucker Convoy. A group of lawyers filed a complaint to the Canadian Judicial Council, which was summarily dismissed, arguing that Wagner's criticisms undermined confidence in the impartiality of the courts. As Pardy notes, the Ethical Principles for Judges guidance specifically states that "statements evidencing prejudgment...may destroy the appearance of impartiality," and judges "should avoid using words or conduct, in and out of court, that might give rise to a reasonable perception of an absence of impartiality." Wagner himself participated in a 2015 decision in which the Supreme Court said, "Traditionally, judicial comment on political matters is regarded as inappropriate." We are free speech maximalists, but judges do not have unbridled free speech. That's part of the bargain of becoming a judge. They must at least keep up the appearance of neutrality by declining to comment on matters that may come before the bench or that may disclose a particular bias. Chief Justice Wagner must recuse himself from this case, if not step down entirely, to preserve the integrity of this institution.

"In Canada, legal equality now means equity. Equity means unequal treatment. The same laws and standards do not apply to everyone. Instead, laws and institutions can treat different identity groups differently. In criminal sentencing, as in applications for jobs, schools, and programs, some Canadians are more equal than others. Canada’s justice system is broken. To fix it, equity must go." It seems, when unequal treatment is applied then, victims are also getting unequal treatment. This leaves us with different classes and tiers for victims. Did the courts even consider the outcome of swapping out equalty for equity. In a sense they do victimize the victims.
