@Informalib @nytimes The transatlantic slave trade was legally sanctioned from the early 17th century until Congress passed the Act Prohibiting Importation of Slaves, which took effect on January 1, 1808.  Slaves imported in 1808 and later were not imported legally, but descendants were covered.

The slaves brought to the US were here lawfully (even though enslaved) and were subject to US jurisdiction, so their children, who were born in the US, were never subjects of another country, and the 14th Amendment granted them citizenship. Just as Wong Kim Arks parents were residing lawfully. These cases clearly show that lawful residency vs illegally being in the US are the key to birthright citizenship. So foreign tourists, and illegally squatting aliens, are not included in the 14th Amendment.
