Those pesky juries causing the backlog! Here’s what happened to me on March 13 at Nottingham crown ct. 1. Prisoners were late into court because there weren’t enough staff in the cells to take them off the vans. 2. Ct 7 - confusion reigns. Court thinks my client is in custody (they’re on bail) my co accused may be coming from prison or perhaps they are on a video link into court? No one is sure other than that, 3 years after both were charged the case is a mess and we need to return in 4 weeks time. 3. Meanwhile in Ct 8 the equipment isn’t working. Prosecuting counsel calls my colleagues phone which is placed near the Judge so she can conduct the hearing. Because the video link isn’t working we’re also missing a defendant & another barrister. We go off to next week. 4. Ct 9 - why hasn’t my client been brought to court ?No chance of getting him on a video link because the equipment isn’t working here either. @DannyShawNews @KarlTurnerMP @BarristerSecret @Kirsty_Brimelow @TheCriminalBar

@Alverd_Dralshya @DreyfusJames I think you will find that ‘trans’ is a long time abbreviation if transvestite. A teansvestite woman is a man in women’s clothing. Not sure the word transgender existed 20 years ago, when being transvestite was widely used.

@DreyfusJames But she is clearly and hilariously wrong. Trans is short in this case for Transgender, It is an adjective, not a compound noun. we don't compound adjectives into nouns like this, There's no noun of Tallman, or Whiteman, or anything like that in english, So it makes no sense.

Frankly I’m ashamed and disturbed to live in a country whose institutions & processes can cruelly & relentlessly persecute a good kind hard working nurse such as Lucy Letby over a period of 10 years & it’s still not being resolved despite overwhelming evidence she is innocent

@drphilhammond So, you accept it’s not true that the case against LL was so flawed ‘everyone agrees’. People are telling you the evidence against her was reliable, well understood and agreed. You repeatedly claim the opposite.

I’m in the privileged position of having access to a lot of experts. I have asked clinical biochemists, chemical pathologists and metabolic medicine experts to comment on the reliability of immunoassay tests for insulin and C peptide in neonates, and specifically what the results in the Letby cases could have meant, and why the Liverpool lab stopped measuring C-peptide at 169 when the machines manufacturers say it should go down to 3. And also, how common it is in quality control tests for people to mix up the C-peptide and insulin readings, which also appeared to happen at this laboratory. This is very typical of the response that I get; “This Letby case is causing factions across the UK in our Clinical Biochemistry networks, WhatsApp groups, e-mail lists, etc. I am keeping well away even off the record!” In essence, there is significant disagreement on the reliability of the tests in neonates and the performance of this particular laboratory, but even consultants are frightened of speaking up, either way. But the point is that the jury should’ve heard both sides of the argument and didn’t. Probably because these experts don’t want to be experts in criminal trials and be ripped to pieces by barristers when they would rather be safely in their laboratories.

@drphilhammond @PrivateEyeNews You misunderstand, mis-state the process. Myers team tried but couldn’t find experts who could make such claims under cross examination. The idea a leading KC team ‘missed the obvious’ in such a case is like a Dr missing a gaping wound in a patient’s forehead.

Why could Ben Myers find no expert witnesses to defend the insulin poisoning theory, whereas Mark McDonald has found plenty? Letby’s fate was effectively sealed at the pre-trial expert meeting, when experts on both sides agreed exogenous insulin had been given to two babies, alongside a theory as to how Letby might have secretly spiked nutrition bags. The jury never heard expert explanations of the unreliability of the tests, particularly in neonates, and the far more plausible causes for the prolonged hypoglycaemia in these two particular neonates. The judge knew about the expert agreement on exogenous insulin before the trial started, the jury found unanimous guilt on the insulin cases and were then directed by the judge to use this finding of guilt in making judgements on other cases. Even if the CCRC concludes there is reasonable doubt in the insulin cases, having been given very detailed experts reports that the jury never saw, Letby may not get an appeal because these experts could have given their evidence at the original trial. Which comes back to my first question. Why couldn’t Myers find experts prepared to challenge the insulin poisonings when McDonald can? My full report on the pre-trial joint expert meeting is below. @SCynic1 In fairness to KS, Barbara Mills was the DPP who created the culture of the CPS ‘pursuing no case unless very sure of winning’. The period 1998-200+ saw thousands of victims denied justice on specious ‘evidential’ grounds.

I think my own Keir Starmer story, may shed some light on how he makes decisions. In 2006 I prosecuted a difficult case of manslaughter against 4 young people in respect of the death of another young person, who had a heart attack running away from an assault. We won. 1/7

@journolj Did you know the defence can ask multiple experts for an opinion and then not tell the prosecution about any of them except the helpful one. The prosecution must disclose all experts they speak to. Weird, isn’t it? Happens in lots of big cases.

@Positively4thS Did I miss something? I thought she had been convicted twice and twice found to have no grounds to appeal. What court or process has overturned her conviction? Or do you mean you think she is innocent because of what you have chosen to read? Idiot Wind?

Meanwhile, as summer turns into autumn, Lucy Letby is still in prison and she is still entirely innocent of ever harming or attempting to harm a baby.

@drcmday No, the NHS is abusing its resources and the legal system to cover up managers’ wrongdoing. Its ’deeper pockets’ strategy prevents most cases even reaching hearings. Not only is a duty of candour needed, personal liability should be introduced.

The UK legal system is haemorrhaging credibility in how it handles NHS cases. Whether its #LucyLetby or my example below.
