This case from Belagavi, Karnataka is not just about a murder—it is a brutal reflection of how personal betrayal combined with legal blindness towards bigamy and live-in relationships can destroy an entire family, pushing the next generation towards irreversible decisions. As per police records, the accused believed that the deceased had eloped with his mother nearly a decade ago and later settled elsewhere without facing any legal consequences. In a country where male bigamy is criminalised but female bigamy, desertion, and parallel relationships often escape scrutiny, the emotional and social cost is silently transferred to children—especially sons—who are forced to grow up with unresolved trauma, stigma, and rage. When the man returned to the area years later, the accumulated anger of a son who watched his family collapse allegedly exploded. Consensual Relationship Not Rape Without Proof of Deception: Karnataka High Court Upholds Acquittal in ‘Promise to Marry’ Case The Karnataka High Court has refused to interfere with the acquittal of a man accused of rape on the false promise of marriage, holding that a consensual relationship between adults cannot be criminalised unless there is clear proof that consent was obtained by deception or misconception of fact. The Court dismissed the State’s appeal challenging a sessions court judgment which had acquitted the accused of offences under Sections 354, 376, 420, 504 and 506 read with Section 34 of the Indian Penal Code. The prosecution case was that the complainant came into contact with the accused through an online matrimonial platform in March 2020. It was alleged that the accused assured her of marriage, confined her at his residence for a few days during the COVID-19 lockdown, and had sexual relations with her. After the relationship ended, a criminal complaint was lodged alleging rape on the false promise of marriage. The trial court, after examining oral and documentary evidence, acquitted the accused. The State challenged this acquittal before the High Court. Upholding the acquittal, the High Court placed significant reliance on the complainant’s own statements. The Court noted that the complainant had categorically stated that she was not willing to marry the accused as she did not have confidence in him. This admission, the Court held, struck at the root of the prosecution’s case that the sexual relationship was based on a promise of marriage. The Court also took note of the fact that the complainant had earlier approached senior police officers only seeking that the accused be called and advised, rather than seeking criminal action, indicating a personal dispute rather than a criminal offence. On the allegation of rape, the Court observed that the complainant had not specifically alleged forcible sexual intercourse. Even assuming physical relations took place, the material on record suggested consensual involvement. The Court clarified that the condition of the hymen or absence of injuries cannot, by itself, establish rape. Relying on settled Supreme Court jurisprudence, the High Court reiterated that consensual sexual relations between adults do not amount to rape unless it is shown that consent was obtained by a false promise of marriage made without any intention of being fulfilled. Finding no perversity or illegality in the trial court’s reasoning, the High Court dismissed the State’s appeal and affirmed the acquittal.
