And whether we agree with it or not, that isn’t how our immigration system works. Some individuals can be removed quickly through expedited removal, or by reinstatement of a prior removal order. But many others become entitled under federal law to immigration proceedings. Depending on the circumstances of each case, the person may apply for asylum or other forms of relief, or file an appeal and remain in the legal system for months or even years. We’ve all been witness to immigration policies that are frequently challenged in court by Democratic states and left leaning advocacy organizations. When those courts issue injunctions or stays, rulings can delay or alter how certain policies are enforced while litigation continues. Frustrating delays like these just highlight that the most effective immigration policy begins at the border. Once someone is inside the country, the legal process can complicate and slow down enforcement.
