Where is the harm for us should Mubikwa seek to interdict the impeachment process pending the finalisation of his review application especially if we think the CC has directed parliament to impeach him, and his rights have already been exhausted?

@MzwaneleManyi @richardcalland Is the review of the Panel report by the president a suspension of the Concourt Judgment? The impeachment process has got nothing to do with the accuracy of the panel report.

What Prof @richardcalland misses is that launching a review application is not the same as setting a report aside. Filing papers does NOT suspend impeachment. Prospects of success are near ZERO. Even if successful, the judgment can still be appealed.

The President is merely formally appointing the judge recommended by the JSC. President has no say in who is appointed to positions on the High Court. He is bound by the JSC recommendation.

@CyrilRamaphosa The s89 panel may have errors, but the questions that you need to answer outside the panel is what did sell exactly to have the $ in your mattress? The Reserve Bank, SARS, PP, police tried to shield you, but whether there’s s89 report or not, the NA has a right to impeach you.

I was advised by my legal team that the panel report was capable of being reviewed by a court of law on several grounds, including the misconception of its mandate, grave errors of law and unfounded conclusions of fact.   However, the outcome of the vote of the National Assembly in 2022 stopped the process of further examination through a review of the report, resulting in the report having no practical and legal consequence.   I therefore did not proceed at that time with the review of the panel’s report as the National Assembly had taken a decision on the matter.   However, I said at the time that I reserved my right to institute review proceedings against the panel’s report should circumstances change. x.com/i/broadcasts/1…

@PublicProtector The impeachment process will be the same as what is happening at the Madlanga Commission. There are people that will be called to testify, the police, the PP, SARS, Reserve Bank, maybe NPA, Mchunu. This will be embarrassing and see them contradicting themselves.
